CCJ/Defaults - discuss?

    I was on a salaried course, came down with a virus (and was left with MS). I had to leave the course. Then my ex decided he couldn't be bothered to pay child maintenance. I lived off my Boots advantage card points and Nectar points for a while. I don't think six years is fair, especially when you're in a situation that you can't control through no fault of your own.

    So the proposal is not to reduce the 6 years to 6 months, which would allow people who get them to avoid paying for 6 months before going on a spree again, but rather for settled CCJ's? You could argue that settled CCJ's stay on for a year after being settled, but most people who get CCJ's haven chosen not to pay. Even those in financial hardship could offer a token payment.

    The "pre Action Protocol" legislation was done to give people more opportunity to either dispute or come to an arrangement before CCJ, and maybe this needs to be expanded on - such as rather allowing claims to be sent to the last known address, they have to show they have made checks to validate the address. Since I assume the argument here is not how long CCJ impacts in itself, but how long it affects those with the ability to pay - the people who would have paid before if they knew about it?
