in simple terms , complain and get it quashed and there is no need for any appeal

the NTK came to your dad , not to you , it willl have said he had 3 choices (not you)

    1) pay

    2) appeal

    3) name the driver

I am assuming that said dad was angry and told you to deal with it as it wasnt his problem

whereas he should probably have used option 3) and named the driver, so the driver then gets their own parking charge letter to deal with

Parking Eye have probably stuck to POFA2012

IN WHICH CASE HIM NOT BEING THE DRIVER WONT HELP

so if the complaint fails, he can name the driver and then when the driver gets a pcn in the post , they can appeal it and get a popla code, then appeal to popla (or the driver can pay it) - that way he is out of the picture once and for all, (or until the next time it happens)

if PE have got all their ducks in a row then they may well win at all the stages, meaning the driver was at fault and may need to take his lumps and be more careful when parking in future

nobody is getting at you, we know you were not trained in this topic , I am telling it like it is , which included the fact that YOU did not receive this letter in your own name, chances are you were told to sort out your own mess

in order for the driver to not pay this ticket, either the landowner quashes it, or the driver has to win on a technicality, which may be almost impossible

sometimes when you mess up , you fess up, pay the price and learn from the experience

I am just letting you know so you understand it, we all know that these things happen and that is how these parking companies make all their profits , through simple mistakes and inattention , it can happen to the best of us, but especially to the unwary or newbies like yourself

the driver learned to drive and passed a driving test or tests

the driver was not schooled in this complicated topic called "parking on private land" - we get that , so its not personal

but saying that you received this pcn when in fact somebody else did meant I gave you incorrect information , hence my frustration when I realised that dad had received it and likely given you a b********* over it :)

post #4 of this thread https://forums.moneysavingexpert.com/discussion/5885342/quickie-i-can-name-driver-up-until-when-exactly tells YOU what to do if the keeper wishes to transfer liability to the actual driver so that they have to deal with their own mistakes

the keeper has a decision to make (make your mind up time)

    pay in full

    or

appeal as KEEPER and try to deal with it themselves

    or

name the driver so they get their own PCN to deal with

but the best option is always the landowner cancellation, preferably BEFORE those 3 options above have to be decided upon , so best to crack on for a landowner/retailer cancellation and get back on buddy terms with the RK of the vehicle that is being "borrowed" :)
