    No because you can use the royal 'we'.

    Anyway CP Plus are a cinch to beat for a registered keeper, and will cancel as long as you use the FORUM template (from the NEWBIES thread) not the dreadful one pushed by MSE in their articles.

    OK, and the last thing you need to know is NOT to try POPLA stage in Scotland.

    As covered on a POPLA Scotland thread about ten days ago, that new 'service' requires hapless victims to fess up who was driving before they can use POPLA.

    So, POPLA in Scotland is an absolute NO-NO.

    Get MOTO to cancel it by using that feedback contact this OP mentioned.

  • Update. I wrote to MOTO Customer Services to explain the driver was ill and fell asleep. Explained they had not intentionally abused the parking rules and asked them to consider cancelling the charge as a goodwill gesture as we had nothing technically to appeal with.

    They replied immediately to say they would look into it but would also forward my email to CP Plus and asked me to log an appeal as well with them to freeze the clock.

    I hadn't got round to doing this yet but received a letter from CP Plus today saying the charge had been cancelled in full, no further action needed and apologising for the inconvenience caused!

    Thank you very much for the advice.

    Quite right too!

    These are easy to see off, and even in Scotland, complaining to landowners is Plan A.

    Thanks for this info, very interesting read. have also received a similar letter, albeit undecided which route to go down. We stopped as feeling unwell, and stayed just over allotted time. However, although date of notice specifies a date a week after said overstay, the NTK was not received until approx. 2 weeks and 5 days the day after said overstay.

    Just wondering in your opinion, which would be the best route to go down? As I believe they have a legal obligation to ensure the NTK is received within 2 weeks.

    Same PPC / same services?

    There's no harm in sending first appeal to the PPC and also complaining to the landowner. Belt & braces.

    Thanks MIstyZ, Yes, same PPC, MOTO Services too yes. Should I be wary of appealing to PPC with the legal side of you were late with your letter and then to MOTO complaining only just over as we were feeling unwell? Conscious of two slightly different angles.
    Would it also make a difference if the discount window ended today?

    No need to emphasise alleged overstay to MOTO. Just say that you've received a PCN for (wording on NTK) and explain the need to rest. If any money was spent, reference that. If you are often paying customers at MOTO services, reference that. Do emphasise need to rest in terms of road safety. Strongly request cancellation.

    Landowner complaints and appeals are different beasts and both need to be done. Do not identify the driver in either of them.

    The blue text template appeal in post 1 above is the one to use, usually without any changes as the main purpose is to get a POPLA code with the almost inevitable refusal. Sometimes the experienced regulars recommend an add-on, I don't think I'd bother in this case though, that might be best left in case this reaches the POPLA stage.

    Should have said, if more support / advice is required, you should start your own thread regardless of similarity with this one.

    No need to be wary, with CP Plus just submit the forum template appeal EVEN IF YOU ARE IN SCOTLAND, and they will cancel.

    If they offer POPLA do NOT agree in Scotland, as that requires the DRIVER to be admitted, which is obviously a complete no-no, North of the border.
