Here are some pics I will use:

    1. Prices not shown at the entrance/No Terms

    O2jW8Uo.jpg

    2. Terms on a tiny sign inside the gym - invisible in the dingy gym car park (highlighted in red)

    zDcrCOZ.jpg

    3. No Sign at the gym entrance

    jtisDV9.jpg

    4. Nothing in gym foyer

    WIefuyq.jpg

    5. Tiny sign in the gym

    jWDyx8p.jpg

    6. Inadequate Instructions on the machine

    EFQc9UE.jpg

7 Inadequate signage in the dingily lit car park

    yTajwuf.jpg

I will add all of these in the appropriate places.

So I have re-edited and will add these pics.

Is that the best I can do?

    Regards

I wouldn't show the picture by the gym stairs, at all. Leave that one out.

I would crop the one of the machine, to crop the partial BPA sign completely off on the left, so your pic ONLY shows the machine.

And these pictures should be embedded in the actual appeal document, not uploaded separately. Make the appeal like an illustrated story, one document, as you see in the best examples in the NEWBIES thread post #3.

Great - Will do, thank you.

You can see that sign in the distance at the entrance so yes I agree it's better. I'll crop the machine.

There are prices on the right of the car park entrance but you can't see them when heading straight in the gym.

I will give this ago now thank you.
  • OK - it's been a week since the first appeal went in. I am waiting to see what happens before launching the second one.

    ***WE WIN***

    Thank you thank you!

So I put the appeal in and had an email yesterday:

    [Dear XXX XXX

Thank you for submitting your parking charge Appeal to POPLA.

An Appeal has been opened with the reference 8xxxxxxxxxx.

Smart Parking have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

    Yours sincerely

    POPLA Team

Thank you Coupon-mad, KeithP and anyone else who helped me.

Very impressed and will pass it on.

I have the second appeal going in on Friday but will switch this around a little.

They must have felt they had no case to pursue - they should have thought about that in the first place and not pushed you through all this. In other words, they were trying to scam you out of money to which they seem to accept they had no right.

Write to your MP and complain about this. Ask him/her to support the Sir Greg Knight Bill currently going through its Parliamentary stages.

Just a quick update on this as I see it has been a while. The second appeal worked as well. So I avoided both tickets!
Thank you to everyone who contributed to this and helped!

Well done, make sure you spread the word about these private parking charge notices, the private parking industry relies on peoples ignorance, as most panic and pay up before any so called discount period expires thinking they are legitimate fines ( legitimate authority issued fines can also be challenged)

As for the Gym, if i was you i would shop around and go somewhere else that doesnt invovle that dark dingy hole of a car park
