    Yes, it was the case of Peter Gidden vs The Chief Constable of Humberside and it went to the High Court by way of a "Case Stated"..

    It was completely different to this example. Mr Gidden received a NIP which should, in the ordinary course of events, have arrived in time. But there was a postal strike and it took 16 days. This was not disputed by the prosecution and their argument was that the postal strike provided a relaxation of their obligation to serve the NIP within 14 days. Mr Gidden appealed to the Crown Court and lost so the matter was referred to the High Court.

    Well done we can all google but it was already established that does not apply.

    It very simple, how can an NIP dated two months after the offence be served within 14 days?


    It isn't, and they know that, so it won't be the first NIP.


    I don't know why they can't spare the toner to put "Second Issue" or something on them but they apparently never do.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    Well done we can all google but it was already established that does not apply.

    I didn't google it, I knew of it from memory and I have the High Court ruling bookmarked..I also know that Mr Gidden is one of the regular contributors to Pepipoo. I pointed out that it did not apply and I thought readers might be interested to learn why. I thought we were having a discussion. I didn't know we have strict terms of reference trom which we cannot stray.

    Giddens is an old case, I've not seen you on that site and you only appear to regurgitate stuff that's already online here trying to pass it off as if you're in the know. So what's your experience on such matters?

    Gidden is 2009, I think (though of course it still remains an authority for such matters).

    I don't claim to be "in the know". I just happen to have a little knowledge that others may find helpful in tackling the problems they post on here (and which, in the main, they could learn from other sources as I have). What experience I have is neither here nor there. People can either accept what I write or not, it makes no difference to me but I try to avoid posting on topics when I don't know the answers (or if I do I qualify it with something like "as I understand it").. I'm quite sure (and I hope) that if I post anything that is grossly misleading or incorrect somebody will put me right.

    I'm not trying to score points (as you say, I've already got too many). All I'm trying to do is to directly answer questions or add to the debate. I'm sorry you don't like the way I post. I don't like being unjustifiably criticised for no particular reason. But I suppose we'll both have to just put up with it.
