PPI Rejected - Is this fair?

Hello,

I recently realised that I had PPI with MBNA which started in Jan 2009.

2 months (June 2018), I made a PPI complaint to them which was rejected (although they paid Plevin). This was the reason given:

"I've checked our records and they show that we wrote to you on 14th May 2013 inviting you to raise any concerns you may have had about the sale of PPI on your account. Our letter was sent to xxxxxx xxxx xxxxxxxxxx (my home address). In our letter we also explained that we may reject the complaint if any concerns we not raised within the next 3 years"

"We are rejecting the complaint as more than 3 years has passed since we wrote to you..."

Is this right? Can I now not claim the money back? I can't remember ever receiving that letter and I cannot find it in my records, and in truth I didn't even know what PPI was back then so don't know if I would have acted upon it at the time even if I did read the letter. Does it matter?

Any help would be greatly appreciated...

    Yes, that's correct. Any complaint is now timebarred.

    It does follow the rules set up by the FCA. MBNA are known to have sent CCLs which trigger the 3 year timebar.
    Can I now not claim the money back?

    That is what they are saying.
    Does it matter?

    If the address they sent it to was correct, then it doesnt matter. It is considered received.

  • this is what's called the timber process. lenders proactively sent letters detailing exactly what they've explained in your letter and the timescale was 3 years. the only appeal you can have against this process is if you can prove you weren't at the address they proactively wrote to, which in this post it seems as though you were at that address. completely fair and no matter what you do next you won't get that money back. even the FOS can't help
