County Court Claim - BwLegal

Hi, not going to make excuse as to why haven’t sorted this earlier.

I received two parking fines at my free to use university car park. I had an outdated permit. After receiving the first I applied for a new permit and the second fine was whilst waiting for my new permit.

Another student in same position wrote a letter to the Total Parking Solutions and had one fine cancelled as they proved to them they was a student. I spoke to someone at my university didn’t receive any help and I tried with Total Parking solution via telephone and nothing happened decided to write my own letter what I never got round to doing.

I have received a a county court claim letter yesteday. I have read the newbie post and believe now my next step is to acknowledge the claim but leave my defence empty? What would my defence be?

I have contacted my university as they now have a car parking support team and emailed them situation but is it too late for them to help? Is there anything I should ask from them? Is it likely I can avoid court at this stage? And if I did what would be fine? Every letter from bwlegal states a different amount of my principal debt.

Thanks.

If you have read any of the advice on this site, you should know that you never, ever, under any circumstances whatsoever, phone a private parking company.

They are only interested in one thing, which is getting money out of you by any means possible. They have zero interest in anything you say, and will lie to you, then lie about the lying.

You are dealing with the County Court now, so follow the process.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Quite possibly.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Assume this is Swansea Uni

TPS rarely do court, but did one for this location last year for multiple tickets. There is a thread on it somewhere.
BW may not follow through for one ticket - so how many did you get?

So take it seriously and read the advice in the Newbies thread.
my free to use university car park. I had an outdated permit.

The issue is summed up above. It is not "free". It is "no charge" as long as you have a valid permit. The cost for those without a valid permit, is £100 per event as the signs will explain. The terms will be on the paperwork you signed / agreed to when you took put the permit. Do you have a copy of those?

That's why the NEWBIES thread has example defences, so people don't ask that, but instead copy & adapt one someone write earlier, that is about permits.

Have you done the AOS online (easy, shown in pictures in the NEWBIES thread).
