Help with Appeal ---- Parking company asking name/ address of the Driver

    you can and should IGNORE their request


    there is no legal compulsion to name a driver, they are phishing because ultimately the driver is responsible


    I would do nothing, but its your choice

    They are IPC members so any further appeal would be futile anyway.

  • It is exactly the same request I had and the replies are spot on, they CAN indeed ask for the driver details but you CAN of course refuse to supply them.


    Question, are you actually appealing? I NEVER appealed and was told in their correspondence that my appeal was rejected?????


    This is the game your involved in now with Liars and thieves, personally I wouldn't do a thing unless you get a LBC or LBCCC.


    Oh and NEVER reveal who was the driver, you DONT LEGALLY have to.

    I have actually appealed.
    Formally via the website using the suggested wordings in this forum.

    So their response is only

    1)the driver can appeal or needs to give permission

    So I am thinking of replying to them with same standard wordings in the forum and add....

    That they cannot legally ask for the drivers name .

    I think if I don't respond formally they will cancel my formal appeal and press for money from legal owner of car.

    (In the letter they are threatening me of debt recovery action !!!

    Pointless - as you already know from reading the FAQ (you have read them haven't you??)


    Any appeal to an IPC company will fail as advised in tghe FAQ


    Now yours has failed you are in the debt collector stage where you ignore everything except a lbcca or court correspondence


    They have 6 years to start legal proceedings


    If it comes to that come back to the newbies faq thread for advice on how to defend it

    you can do that repeat appeal if you so wish , although we would not do so

    just do not reveal the drivers details

    EXCEL may well pass it onto debt collectors who can do nothing

    eventually they may issue an LBC or get B W LEGAL to issue one

    and within 6 years they may issue an MCOL or get B W LEGAL to issue one on their behalf

    the only way to settle the matter is in court, where a judge will decide (acting as a referee in this dispute about money)

    Looks like you may have appealed "on behalf of" either the driver or keeper.
    It is that situation that often leads to that query of theirs.


    You need to adjust the paragraph starting "I had recieved a postal APNR..." in your opening post to avoid identifying the driver.
    Perhaps something like:
    I had received a postal APNR camera ticket --(NTK by Excel parking services) which I received on the 17th day. The driver was not issued with any ticket on the day of the contravention. I am the registered keeper of the car.
    I hope you can spot the subtle difference.

    You need to edit your opening post now as the parking companies are known to read this forum and can use your posts against you.
