MET Charge Notice timing

Had a trawl through what is a comprehensive Newbies section.

I received a parking charge notice through the post this week from MET Parking Services for an offence allegedly observed on 07 July, I was not driving, in fact the driver was visiting and lives in Oz, no ticket placed on the car, and nobody left the vehicle all the time it was stationary.

I have taken no action beyond remonstrating with the people at the petrol station who state nothing to do with them but need to take it up with the land owner.

My question is over timing, the seven weeks gap between receiving the notice and the alleged offence? My initial reaction is to stick it in the bin and let them go whistle!

    my initial reaction is that ignoring this PCN would be a stoopid thing to do

    read the NEWBIES sticky thread again , post #1 gives you the correct course of action which is to appeal as KEEPER with the blue text template appeal

    if they dont cancel, you put together a POPLA appeal based on various factors like the POFA2012 failures etc

    until you prove them wrong , they hold the high ground so you have to go through the motions and put them to the sword

    at no time in that thread or on here do we tell anyone to IGNORE a pcn

    the correct procedure for a BPA member like MET is appeal once , to MET , as keeper (without revealing who was driving) - get the popla code and then put them to the sword at POPLA

    I am sure that the NEWBIES THREAD is clear on those points , especially for BPA members

    doing nothing is a fools errand

    that argument only holds water if you name the driver and give a suitable address for them in OZZ, which then absolves the keeper of any further action under POFA2012 rules, plus they cannot oursue them in OZ because MCOL is only for England and Wales

    the NTK would have given you that option

    my option and the one in the NEWBIES thread is simple, appeal with the template, in which case what you are effectively saying is this

    "I am the keeper and not liable for this charge, I am under no legal obligation to name the driver so I refuse , I was not the driver anyway, plus because you failed POFA2012 schedule 4 I cannot be held liable for your spurious charge so you can FRO"


    its your choice if you wish to dob the driver in under POFA2012 rules , OR appeal as keeper and get it quashed using POFA2012 as your shield

    Is the driver permanently domiciled in Australia?

    If so, you have two choices:

    Either continue with your appeal as the RK anticipating a win against MET at POPLA and get this killed off, no involvement whatsoever of the driver.

    Or, provide the name of the driver and their address in Australia (even though they live on the other side of the world, it is, nonetheless, an 'address for service' for the purpose of this stuff). This will require MET to issue a Notice to Driver to them. That gives them something difficult to sort out, especially if your friend confirms their address, with some kind of 'proof' that they are actually in Australia - like sending the confirmation on a post card with an Australian postage stamp on it.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Or both! Appeal as RK and try to beat them at POPLA. If that fails, then you can then name the driver in Australia (can do this at any time up to the start of court proceedings).

    Of course, MET may not "accept" the Australian driver, and continue to purse you as keeper. They would be wrong in law, but when has such a trifle stopped a PPC from acting unreasonably?

    Or do it the other way round, name the driver and give their address in Oz, on the day you get the POPLA code, by email to MET, thanking them for the POPLA code.

    Then wait a few days and then appeal to POPLA with all the usual points, plus starting with the proof email that you told MET the name & address of the driver already and therefore can't be held liable under any applicable law.
