    Get your husband to understand the issue here by reading up on trespass on railway property

    Indigo cannot take this byelaws case to Court,!

    The driver is irrelevant in byelaws cases.

    Only the owner!

    This is all rather confusing.
    However, the scammers do not know the identity of the owner because nobody has told them, and the DVLA don't have that information.

    As far as I can tell, an appeal had been made for 15 PCNs, but for some reason the scammers are refusing to accept them as appeals. Tough luck on their part.

    You have received bog paper from powerless debt crawlers. If you get any more, stuff them in a drawer with the rest. Keep them for six months then use them for hamster bedding or firelighters.

    Either the day to day keeper (the person in charge of the car on the date of the alleged event(s)) or the registered keeper should keep asking Indigo questions about this charge until six months have passed.

    One question every fortnight or so by post, sent first class from a post office counter and obtain a free proof of posting.

    Things like,
    What byelaw has allegedly been infringed?
    Who owns the land?
    Who is liable?
    If it goes to court, what court will this be held in?
    Who has standing to start proceedings for a Byelaws case?
    Why do they keep writing to The Keeper instead of taking this up with The Owner?

    Just keep asking questions by post every couple of weeks for six months. Just make sure the owner is never identified.

    The Driver, The Keeper, and The Owner are three different people. ;)
    The DVLA only have details of the Registered Keeper. They do not hold Vehicle Owner details.

  • I purchased a ticket to park in a station car par. Unfortunately, as I closed the car door the wind must have blown it from the dashboard. Upon return, I had a penalty notice issued. I appealed on-line attaching a photo of the ticket purchased and asking to be excused as a valid payment had been made. I got a standard reply on email rejecting the appeal because I had not displayed the ticket. The bit about "POPLA no longer being applicable..." was mentioned. Interestingly, the penalty notice itself states that "disputes can be referred to POPLA, details of which will be supplied by the parking operator..." so it seems the information on the penalty notice has not yet been updated with the new policy! So, my questions are: does this discrepancy help me; and to date I have only made contact through email - if they wanted to pursue payment they would have to obtain registered keeper details from DVLA and pursue through the post - are they likely to do this? Has anyone had a similar experience with Indigo? Thank you.

    I have just had a letter from ZZPS - signed by an individual who corresponded with my by e-mail, in reply to an appeal letter (CLEARLY TITLED AS AN APPEAL) addressed to INDIGO. This now looks like a complete scam - I am appealing to Indigo who issued a separate unrelated ticket to the 15 above for a different reason and ZZPS are answering rejecting the letter and referring to follow ands appeal procedure stated at the back of a penalty notice! Is that legal - this means that a company who are debt chasers are reading an appeal letter? Pleas help me understand as this all looks very dodgy!

    Also another question - they keep saying a proper appeal procedure needs to be followed -yet at the back of their ticket they give 2 options for an appeal - online or in writing by registered post. They reject to consider appeals by post. Is there an official body we can complain to about this bullying and illegal behaviour?

    You are making hard work of this. It's really very simple. You play mail ping pong with Indigo for 6 months. Ask questions of them very slowly.

    That's it. All there is to it.

    You've asked a few questions here. Why not ask Indigo instead? One question a time. Slowly.

    It is so easy to deal with, ignore them now you have appealed.

    It times out after 6 months and NOTHING HAPPENS except threatogram letters to laugh at - guess why? Because Indigo's contract only lets them issue 'pre-action letters'. Nothing more. Indigo can't take this pseudo 'penalty' to any court.

    Then it times out. :)
