indigo penalty notice

Help!
I've just received a parking penalty notice of £100 by Indigo at Lancing Station. Asda is also located by the station car park. I could not use Asda's main car park as it is situated at the back of the store and i'm disabled and cannot walk that far. There are only 4 disabled bays and they were in use. I parked in a small area at the front of the store which i didn't realise was 'station only' parking until after i moved the car. There was a sign however above the parking bay which said that disabled drivers could not park without a valid blue badge. It did not say that disabled drivers were prohibited from parking there? I have a blue badge which i displayed on my dashboard with time of arrival. I was only parked there for approx. 15 minutes. I spoke to the Indigo employee and showed him my badge. He apologised for giving me the ticket and told me to appeal advising that there were no free disabled bays and that he couldn't cancel it once it was issued. Should i appeal? Is this a case of discrimination?

Then once you've had a look at that read this https://forums.moneysavingexpert.com/discussion/5803499/indigo-railway-pcn-clarifying-the-process0

I've read the newbies post but nothing refers to disabled parking. Should are just ignore the notice?0

The Newbies thread talks about railway parking, which is what this is. Where in the Newbies thread does it say to ignore a ticket?
You also need to read the thread I linked to.0 -
disabled parking and blue badges are not law on private land , forget that aspect
read about indigo / railway land and how any appeal will be fruitless , no popla code , no county court , and it times out at 6 mths #
thats all you are getting , now read up and understand0 -
disabled parking comes under the EA2010 and not everyone covered by that act has a BB nor can get one
in your case you have a BB which means that the EA2010 covers you as well
BUT , if you read the blue booklet that comes with your badge it states that private parking is or may be covered under different rules, and as railway stations and airports are covered under bylaws, then those bylaws may vary too
my point ?
the BB does not cover you for each and every disabled bay in the country, because special conditions may apply , like paying to park and getting an hour extra for example (like on council car parks around here)
as this is INDIGO, then its a railway station car park covered under bylaws , and although you have a dispute that could win in court, its up to the TOC (not INDIGO) to take you to MAGISTRATES COURT within 6 months
in the meantime , you appeal as KEEPER to INDIGO using the blue text template "as is" - no changes
then when they refuse the appeal , you string it out over 6 months , by which time the TOC cannot issue a penalty notice and take you to MAGS court
yes its complicated, which is why there are hundreds of INDIGO cases on this forum that explain the basics , the fact that you have a BB just chucks the EA2010 into the same mixing bowl
but in future, read and comply with the signs where you park, as not all those places are "free parking" , dont fall into the trap of seeing the disabled bay symbol and assuming you can park there free of charge
ps:- the ASDA disabled bays are also on private land , where different rules may apply , like a maximum time on site for example , so each case can be unique0 -
Thanks for your help. As the sign said i could park with a BB i wrongly assumed that was ok. I will appeal and see what happens.0

Presumably you CAN park with a BB, but have to pay to do so
As you know, from reading your BB guide, it has no entitlement to free parking on private (or indeed, byelaw controlled) land.0 -

I am sure that the sign DID say that and yes it was "OK"
but the question is , WHAT ELSE did it say ?
l;ike did it say that the driver can park there but must pay £2 for an hour for example (as well as displaying a blue badge)
the devil is in the detail, and I suspect that the driver failed to notice that BB holders also have to pay to park and so the driver failed to do so0 -

Times out after 6 months and it is NOT a real fine. Nothing happens except letters.
I live quite near to Lancing so if you pay this, I will come round and put a bat up your nightdress!
Don't worry, I am female, non-threatening and I am joking, BTW, but I am local and you DO NOT pay this. Wise up to what this is - a scam.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
