Faulty appliance - must they take it away?

Hi

I've accepted a settlement figure for a 2 year old faulty tumble dryer, and Argos are insisting on collecting it before paying out.

On this occasion I don't mind as it's useless to me, but if I'd have said I want to keep it, could I have? Anyone any experience of when they want to keep something e.g. for spares?

    But many of these companies no longer have a person to ask .

    It sounds like you have negotiated a settlement - i.e. you reached an agreement that both parties were prepared to accept.

    It's up to you and Argos what you mutually agree on...
    1. You could both have agreed that they pay you some money and take the dryer away
    2. You could both have agreed that they pay you some money and don't take the dryer away
    3. You could both have agreed that they give you a new Ferrari
    4. You could both have agreed that you pay them £5000

    But I guess Argos wouldn't agree to 2 or 3. And you wouldn't agree to 4.

    But you were both prepared to agree to 1.

    It's not a certainty. I have had situations where the retailer isn't interested in getting the faulty items back. Although these have always been completely unrepairable which this dryer perhaps isn't.

    But I'd never expect a retailer to let me keep a faulty item, that's absurd.

    Provided that you have space to keep it, it might well come in handy in the future.
    Things such as the pump (if it has one), motor, filters, door seal, condenser unit (if it has one) could possibly be used to fix the newer appliance.
    This is after all, a money saving website.

    Assuming that the retailer will in turn try to make a claim against the manufacturer or wholesaler, how do you think they can do that without taking possession of the product?
    No free lunch, and no free laptop ;)
  • If you had built a washing machine and after two years service had to give the buyer their money back and they said "Can I still keep it?" would you let them keep it?????
