NCPL Dispute Help

Hello there,

I'm seeking some assistance with an CC Claim document received regarding a parking fine. This is my first notification from both a solicitor firm and CCJ both received on the same day, both dated same day.

I called the solicitors to ask what it was about and requested evidence as I am 100% certain a ticket was purchased on the said date, I know this as I had to walk back to the car take a picture of the reg so I could input it into the machine, then walked with my mother into a medical appointment... I remember it clearly. They refused to give evidence stating I should request it through the CC Claim documents... very helpful! The also refused to give me the contact details for NCPL so I could contact them direct so I could request the evidence, again I was told go through the Courts. I asked if they didn't have evidence on their file how could they make a claim with the courts... "because we can" I was told.
So, I have the Court documents N1SDT & N9B & N9A, I am confused as to how to respond without having the physical evidence to defend myself.
Any advice would be greatly appreciated.
Thank you :-)

Yes of course they can file a claim. Anyone can file a claim with or without any documents. Sucks, entitrely.

Have you read the NEWBIES THREAD, POST TWO which goes through the court process COMPLETELY, including diagrams?

If not, you MUST DO SO NOW. You will not get further help until you have done so and confirmed you have completed teh Acknowledgement of Service

What is the DATE OF ISSUE?
  • Thank you I will have a read of NEWBIES THREAD, POST TWO.
Date of issue is 13 August 2018.

Not giving you information is the normal process parking scammer and their agents use. They do it because they can even though they know it is wrong.

Post 2 of the NEWBIES guide to court by bargepole will walk you through this step by step.
Start with AoS, Acknowledgement of Service. You acknowledge the claim and state that you will defend, but do NOT put anything in the defence box, not even a full stop.

During your defence process you will point out the lack of information telling the court how this is unfair and constitutes unreasonable behaviour.

MSE has a very good record of beating these scam claims, but there is no quick or easy fix. Just follow the advice and you should be OK.

You should also complain to the SRA about the solicitor's behaviour, and to your MP about his unregulated scam.

The Sticky thread for NEWBIES is just underneath where you clicked on the newthread.gif button.

You should read it from post #1 anyway to find out how this disgraceful unregulated scam works, and use the info in red to complain to your MP.

The guide to court that you want is in post #2 of the NEWBIES.

With a Claim Form Issue Date of 13 August 2018 you have until 1st September to complete the Acknowledgement of Service but there is nothing to be gained by delaying.

You then have until 4pm on Monday 17th September 2018 to file your Defence.

That's over three weeks away but don't leave it until the last minute.
