The bike needs to be as described. It wasn't.
If they are not forthcoming with a full refund, then you need to start court action. Send them a letter before action giving them 14 days to refund in full.
I assume you took photos of all the things wrong with it before returning it immediately?
Yes all photos and a video, i have every text saying the bike was in good working order, her saying I will refund on return after i listed the issues, original add and pictures from that,
I also rang them with major issues within 10 minutes of receiving bike.
They say the courier must have bashed it but the issues were not cosmetic.
She is now saying today that she will get a cost for repairs and refund difference and that I have to take it up with the courier. I haven't replied and i am just going to send a letter stating small claims court action within 14 days unless full refund given.
It's about the principal more than the money now. If it costs me more in court fees so be it.0 -
OP, I will assume that you are new to motorcycling. For future reference buy local and inspect the bike personally before parting with your money. If you are not too familiar with bikes take someone who is. Buying over that distance from a complete stranger is a seriously ill-advised.
In this case you have either fallen pray to a scammer or, at best, bought a bike some someone's mum who has been informed by their dear offspring that it is in pristine condition and will not hear otherwise from you or anyone else. Personally, I think the former applies.
Your only recourse would be litigation but there is a real risk here that you will be throwing good money after bad. You may be batter off cutting your losses, walking away and chalking it up to experience.
What was the bike and how much did you pay for it?
It was a scooter for my son and paid £900, nothing local that I could find any good in the budget, i know what to look for an believe i am a good judge of character..
The exhaust was rotten and been bodged with the old 2 jubilee clips trick. But the issues were more and more the longer I looked over it, engine wouldnt always tickover, their was a drive issue (auto) rear brake had no resistance at lever and didn't work.
It had mot 6 weeks ago and has covered 247 miles since mot.
It didn't even get ridden by me, started a handful of times and sat in my garage till it got collected.
I have all text messages the ladt one me listing the issues and her agreeing to refund me on return. I tried to negotiate a part refund and sent links with cost of parts, she wasn't interested and asked for it back.0 -

I feel your pain.
My OH's daughter has just passed her CBT and I am looking for a scooter for her. I initially set a budget of £1,500 but everything in that bracket is either a wreck or Chinese. I guess it is because of the type of owner that scooters attract - young and skint. Bought, abused for a year and then passed on with no maintenance or mechanical sympathy. (Finding a decent 125 for my OH when she learnt to ride a year or so ago was tough for the same reasons but scooters seem to be even worse)
I am now considering new or nearly new for £2K or so. At least that way I know she will be on something that I am happy with.0
