Cifas cat 6 marker - dispute?

Hey there guys

This is my first time posting on MSE forums. I'm looking to get a CIFAS marker removed by the Bank in question. Basically in 2015 I was given a CAT 6 first party fraud marker against my name. Now to just nip it in the bud. It has been rightfully placed. I made a terrible mistake and I was naive to think it wouldnt have recurring consequences.

At the time I didn't know much about CIFAS at all and only knew about experian. I managed to open another bank account whilst the fraud was being investigated and thankfully that account of mine is still open and running. Fast forward to 2018 now, I am planning to change jobs and ironically I work in the finance industry. So two of my jobs offer have fell through due to the CIFAS marker which is causing me extreme distress.

I'm not looking for any sympathy whatsoever. But I am considering to open a complaint at the Bank who placed the marker to request if they could remove the marker as it's affecting my employability. I don't know what they'll say but in my complaint I am happy to included character references from very recent employers to prove that no such fraud has taken place since the initial incident. And that I am a worthy employee. I'm not sure if they will overturn their original decision but one can only try.

Would be great to hear your views on this.

    You have the right to open a complaint and escalate to FOS if they don't agree but bear in mind that as the information recorded is, by your own admission, accurate that they have every right to refuse to remove it.

    FOS tend to not order the markers removed unless there is doubt as to who perpetrated the fraud or whether it was fraud at all, so be prepared for a rejection. Nothing ventured, though.

    Why would you call it a complaint? As above, no harm in asking nicely but it may be counterproductive if you label it as if they did something wrong, when, as you concede, they didn't....

    What were the circumstances of the fraud? Which bank?

    Yeah I mean I don't think there would be any point escalating to FOS only because it was a mistake I made rather then the Bank but I agree that there's no harm in requesting the Bank nicely.

    Honestly there's no harm in escalating to FOS either. It's unlikely to get you anywhere but unlikely doesn't mean zero chance.

  • I am in no way going to imply to the Bank that it's their fault as it wasn't, simply will admit to what happened and hoping they can see the predicament that I am in with regards to my employability. Will obviously include references from individuals who work in financial services and whom I have worked with to prove that no such fraud has taken or will take place in the future. Fingers cross I really hope they overturn their decision. I mean it's coming up to 4 years that's it's been on CIFAS.

    Look at jobs outside the financial type as no point takung knockbacks as you know they will reject you due to the marker.

    You will also struggle to get a job within the legal and accountancy fields too due to the marker and a lot of firms check due to their own indemnity insurance.

    Once it is removed you can then return to whatever it is you are trying to get into.
    Mortgage started 2020, aiming to clear 31/12/2029.

    Did your fraudulent activity cause any losses to the bank in question? If so, have you made restitution? If the party that was defrauded was not the bank, have they had their losses made good?

    These arguments could strengthen your case.........or blow it out of the water.

    The fraudulent activity did not cause the Bank any losses in question. Nor did it affect them adversely. The bank managed to retrieve the funds in time. I agree that I could weigh the arguments you mentioned to strengthen my case but I also don't want to come across too confident if u know what I mean.
