Debt Recovery despite no notification from PCM

Hi,

I am writing to ask advice about the situation I find myself in.

I have recieved 2 letters from Trace Debt Recovery stating that I must pay 2 seperate £160 parking fines. I have not and will not contact the debt collectors.

My issue is that this is the first I have heard of any parking ticket, I received no window sticker, nor any letters in the post (I have not moved house).

I contacted PCM and they refuse to engage in conversation with me, they claim they sent me 4 letters (which is a lie as I would have, perhaps naively, paid it right away). They say my case is now with Trace and I must contact them- which I won't do.

On the PCM website I can see via photographic evidence that my car was parked in a private area (an accidental occurrence, I had never noticed any signs and in one of the incidents, there is no photo of a sign in the evidence).

I am writing to ask for advice regarding my next step? I have never received any letters from PCM, the first I have been made aware of either parking ticket is by the letter from Trace.

Feeling stressed and worried.

    come back if PCM or their solicitors send a formal LBC, or an MCOL, within 6 years of the parking event

    read post #2 of the newbies faq sticky thread about LBC and MCOL stages


    also, send an SAR to PCM under the new GDPR 2018 and obtain copies of all paperwork and photographs etc, anything they have on you or the vehicle

    Post four of the Newbies Sticky, which you agreed to read before posting here covers debt collectors in their entirety, so you really don't need to be posting debt collector threads.

    I have read it, I just wondered really if anyone could shed any further light on the fact that PCM had failed to notify me of the tickets prior to the debt collector letter. I wondered if this is common practice or grounds for dispute, how I could prove it, etc.

    it may well be common but how do you prove a negative ?

    all they have to do is prove that they sent them by an approved postal method like royal mail, with proof of posting like you get from the P O Counter (and correctly addressed)

    they do not have to prove they were received by the keeper or driver, the letters are deemed to have been "received" two days after posting, especially if using the Royal Mail service

    you do not have to prove anything , you have to allege that they have failed certain legal points and therefore ensure that they have to prove that they followed the correct procedures, with proof , to a judge

    they are the ones alleging they followed the rules and laws and they allege you owe them money, so you are putting them to stricty proof , in a court of law , IF it gets that far

    hence why I said drop a SAR bomb on them

    Twinkletwinkle123, can you confirm that the vehicle's Keeper details held by the DVLA were correct at the time of the incident?

    Have you changed address recently?

    Yes I can call them and do that. No, we have not changed address. This is how I know there is no way PCM sent us any letters. Thank you

    Have you sent a SAR to PCM (and not phoned them)? You want all letters sent, and all photos taken and all data held about you and this car.
