PPI gone all wrong :(

I received a letter from Santander, offering me just over £5,700 So I phoned up the ppi company dealing with this case, only to be told I’m in arrears with Santander from a loan which was taken out many years back, I genuinely have no recollection of this old loan, I’ve been separated with the ex wife for over 4 years now and she’s told me it’s in a debt management that she’s paying, now this ppi company are asking for there 25% of the settlement which is just over £1,700.. I’m trying so hard to get back financially after my separation and this has just kicked me right down.. any help please..

Not sure any help can be given. I'm assuming it was a joint loan for the off-set to happen?
At the end of the day the claims company need paying as you agreed they were entitled to their fee. You will need to make a payment arrangement.0 -

Unlikely. Claims companies are very impatient and keen to get paid.
However, if that is all you have and a judge agrees, even a CCJ wouldn't change that.0 -

Do you mean you were offered £5700 and need to pay the CMC £1700 but you aren't going to get any money because it's being used against the debt?
If you are not going to get any money but owe the CMC then I would suggest a complaint to the CMC about the loan arrears issue (they'll likely reject it) but then you can complain to the Legal Ombudsman about the CMC and see what they can do to help. CMC should ask if there are any debts or historical payment problems before taking it on. Maybe they did and OP made a mistake, maybe not, we don't know.
If you look at the below (it's case study 1 in case link doesn't work properly) a CMC was told to cancel their charges to a person who used them because of the misleading/poor questions on their form which led to the person using the CMC even though they would have never got their money back because they were a bankrupt. CMCs are notorious for being slapdash and it's quite possible they never asked the OP the right questions or checked to see if there was written off debt.

It was a genuine mistake from me, I didn’t know I had this loan, has I don’t pay it, the ex wife pays it through her debt management company which i only found out yesterday! No money comes from account to Santander or no money goes to my ex wife to pay Santander only maintenance to my kids!
I’ve phoned the ppi company up and if I complaint, I should take it up with sanatander has they were only made aware of the arrears yesterday! And there’s nothing they can do.0
