ParkingEye ALDI fine received notice for keeper liability

Hi All,

As the registered keeper of the car I received a parking fine for £40 from Parkingeye , this has now jumped up to £70 in a second letter, I stupidly opened these much later and not sure when they arrived exactly.

Date of alleged contravention at a ParkingEye managed ALDI Car park: A last week's date of/ June/2018
Duration of stay: 40 mins
Date on 1st letter issued (£40 fine): A 1st week's date of /July /2018
Date on 2nd letter issued (£70 fine): A 1st week's date of/Aug/2018
Image of car on entry and exit only (ANPR) with time stamps

I was not the driver of the vehicle at the time of the alleged contravention, The driver parked and shopped at ALDI but was not aware of the required procedure of parking there. I have revisited the place and I feel there is inadequate signage from where the vehicle was parked

The 1st letter contains image of the car on entry and exit only & the standard text of the 2nd one (imgurDOTcom/a/KY9KiIw) contains no image at all but it says I cannot appeal anymore as 29 days have passed..worrying specific text is

"the requirement of Schedule 4 of the Protection of Freedom Act in respect to keeper liability has now been satisfied and as 29 days have passed from the date of notice of the Parking Charge was given, Parking Eye now has the right to recover any unpaid part of the Parking Charge from you, the registered keeper"


After reading the letter I asked the driver to find the receipt so we can write to Aldi or appeal to ParkingEye as suggested in the forums but alas they can't find it


Sorry if the information is already present in there but I have read the newbie forum but still have the below 3 questions , any help would be much appreciated.

1> Doen the 2nd letter rules out the golden 'Golden ticket' route ?
2>Considering the date of the alleged contravention was in the date above do I stillhave the right to appeal to ParkingEye to get a POPLA reference or they won't provide me with one now ?
3>What is the best template to use for my case if I can appeal at this stage. I am considering the MSE forum post number p=71285691&postcount=2341 in light of the inadequate signage

but pelase let me know if any further info can be added ,does this need to be submitted in the parking eye 1st appeal or for a POPLA one?

    you missed some info from the dates, but PE had 14 days to get the NTK to the keeper for POFA2012 to apply

    if they failed, then POFA2012 does not apply - regardless , meaning a keeper is not liable

    if the keeper failed to appeal within 28 days , then PE do not have to provide a popla code , nor will they do so

    without the popla code, you cannot go to popla, the code is essential and too late means never

    the NEWBIES FAQ sticky thread gives the template appeal for a KEEPER , but if adding a POFA2012 paragraph then do so, as long as the DRIVER is not identified, assuming their website allows the appeal, then try it anyway

    ideally , you get the landowner to cancel the pcn, ASAP

    I did both things as you suggested


    1. Wrote to Parking with the keeper appeal template through their appeals portal (received an acknowledgment by email )


    2. Wrote to ALDI customer service describing the above incident and attached my receipt from another day and same photo of inadequate signage as evidence and they wrote back with the following

    "
    Dear---

    Thank you for your recent email regarding the parking charge notice that you received.

    On the basis of the evidence provided, I am happy to contact ParkingEye and get this charge cancelled.


    As you are now aware, ParkingEye manages this car park using Automatic Number Plate Recognition (ANPR) cameras that monitor cars entering and leaving the car park. This system is in place to ensure free parking for our customers.


    I hope that this satisfactorily resolves this matter for you. We value your custom and hope that you will continue to shop with us.

    PE will write to you confirming the cancellation - may take a week or two.

    Keep that confirmation.
