I've looked at post #3 and it states that I should not admit who was driving (neither during first appeal and at POPLA). But I did already entered my name when appealing online to Smart Parking (I wasn't aware of this forum at that time).
The rest of the post #3 keeps mentioning about not admitting who was driving but I can;t find anything regarding what to do if I already admitted.0 -

I completed the appeal online, filling PCN number, my name, address and email. unfortunately as I do it about 2 months ago I don't exactly remember every word and have no copy of it. But I'm pretty sure I typed something like that:
"...Please cancel PCN TCXXXX. It must have been issued in error. I've attached a copy of the parking tickets I purchased... First one purchased at 13:14 for £5 for 3 hours stay, that was valid till 16:14. As payment was not available by card and I only had £3 change left I purchased a second ticket at 15:34 for £3 for additional 2 hours. Therefore from 16:14 with two additional hours I was actually covered till 18:14 and we left the parking around 18:00..."
Smart Parking response was:
"...we believe PCN was correctly issued...please note, two payments were made on the day of contravention. first payment was for £5 for 180 minutes. Second payment was for £3 allowing an additional 60 minutes, totaling a pay amount of 240 minutes.The driver needs to ensure they pay for the tariff rather than the total price....the t&c are clearly displayed on the signs around the site.."
Looking at their response now, I understand why they sent PCN. The signs did not display 1 hour = £1.5. It displayed (as I mentioned previously):
up to 1 hour = £1.5
1 to 3 hours = £5
So what they say is that if I wanted to stay any time between 1h 1min and 3h I should have paid £5 and since I paid £3 this was not enough for second tariff so it only covered tariff 1.
Now that I see it the way they see it, do I still have any chance to go through POPLA and win this or should I just pay the PCN as it looks now like it was my fault because I was using a different logic than then the sign when purchasing the tickets?

Sooo frustrating, this would have been sooo darn easy, cancelled with one appeal.
Here we are again, we do this every day and there are THOUSANDS of posts like yours with POPLA appeals from admitted drivers. Search using the words in bold as keywords.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
