Court action only option 're title deeds?

My partner has a signed separation deed from before his divorce with his ex wife agreeing to sign the house over to him when he can afford to take the mortgage on himself. We are buying a property together and need her name off the deeds before hand but she now says she wont. We have spoke to a solicitor, we will go to court if necessary but is there another option before that? Many thanks for any help given :)

    She is mean to be signing the house over to him AND he is buying another house ? So he'll own two houses?

    Anyway, other than threatening going to court via a solicitor before initiating such court action, I'd say no.

    Is the mortgage on the house in joint names -your partner and ex?

    Does he want to sell the house in order to buy house with you?
  • She lives in a mortgage free house that they both owned which he signed over to her as part of the separation deed.She signed to say she would sign their other house which has a mortgage on over to him as soon as he could afford mortgage which she won't do now. Yes we are buying a house together

    An option which the solicitor doesn't know about but the folk here do? No, there isn't one of those.

    Perhaps she is just being awkward. Has your solicitor written a letter?
  • It is complicated sorry I'm new on here posting in not explaining myself very well
    They had 2 houses one paid one mortgaged
    When they split she went back to paid for house he stayed in mortgaged house he signed his rights over to her she is supposed to sign his to him. She owes him a substantial amount of money agreed by both parties to be paid if ever she sells her house. She now wants to move but not pay money and put debt onto her next property. A consent order was drafted with a time limit on payment of debt she has refused to sign this and has now stated she won't sign to release my partners house as we are moving in together.
