Smart Parking appeal rejected, what to do next

Comments

  • I too received a PCN from Smart Parking and I appealed because I thought the car park sign was deliberately positioned to be difficult to read when entering the car park. I was given the option of paying £40 if paid within 14 days, however because I think they deliberately delayed the response to my appeal I had to pay £70. Like most of us in the U.K I feel intimidated by correspondence from companies like this and so I paid up.
Duing a recent visit to the same car park (ASDA) I noticed that the sign at the entrance had been moved to more prominent position.

I also objected to the DVLA selling on my personal data to private parking companies.

Why do you think you 'had to pay £70'? NO-ONE here pays Smart Parking a penny.

If you are at POPLA stage, read the NEWBIES FAQS 3rd post, about how to win at POPLA.

And start your OWN thread, no more replies here please, this is not your thread.

You were mugged if you paid it, and my comment was factual, not rude.

It was not for paying and we wanted to hear whether you did, and wanted to offer you help to win it at POPLA and see it off.

  • You cannot object ot the DVLA sharing your info, and strictly they arent selling it, they are covering their costs in providing the info.

Yes, you esponded to the thread. With your own irrleevant comments about a different locaoitn. No idea why you paid up, you got dcompletely mugged.
  • Hi All

Again thanks for taking the time to reply, does anybody know where I can find the weblinks that are mentioned, so that I can submit my appeal letter to POPLA

Have you read #7 above advising you on your popla appeal?
  • Go back to the front page of this parking forum

    Read it.
  • Thank You...

I'd missed the signage part in the Newbie Section, however by forcing me to read the whole section again, and this time slowly, I do have a question.

As i received a postal PCN dated the 12/07/2018 for an alleged offence on the 03/07/2018 does this mean i cannot use the NTK defence which forms points 1 and 2 of my defence as this PCN is my NTK

Clearly the date is unimportant, as Smart NTKs are non POFA ones in wording...please don't ask why, compare it yourself with Schedule 4 para 9 if you wish. It is obvious.
