S75 credit card and the used Arnold Clark

Hi, I bought a used VW Golf GTD from Arnold Clark in March! I had under 69k miles on the clock. Alledgedly has full service history and in great condition! The car was valued at £9000 and I paid by trading in my old car and paying the rest on a 0% credit card.

Since having the car I had no problems until last Thursday! I heard a rattling noise coming from the engine!

I called the Arnold Clark branch to ask if they could have a look at the car and diagnose the issue! I was told i would have to wait till the following week, possibly Wednesday before having it looked at. There would also be a fee of £85 as I didn’t take out the auto care warranty when I purchased the vehicle!

I informed the call assistant that I really needed my car urgently as I have to transport my kids around and would have to go elsewhere!

I got my car transported home as I was scared to drive it from work! I got the car collected and took to a local garage who advised me the gearbox, clutch and flywheel are damaged and required replacement!

My question is, if I paid with my credit card does the insurance of section 75 cover any liability for the cost to fix the car given I’ve had it less than 6 month?

Any help or advice welcome!

Allan

The credit card company are jointly liable. So if Arnold Clark are liable for the fault, then so are the credit card company. Since it's been less than 6 months, it would be up to them to show that you broke the car, not for you to prove you didn't.

But it seems odd that the clutch and flywheel and gearbox are all damaged. Did the garage give you any explanation for that? I would be suspicious that they are exaggerating the problem to get more money out of you unless I got a really good explanation.

There's nothing to stop you contacting your credit company and giving it a try.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.
  • Hi, I have dealt with the garage previously and they!!!8217;re reliable! They said the car looks like it has been abused previously!
The car has had 5 previous owners on the log book which is now making me wonder why! Considering the car is only 6 year old!

I think I have been sold a bit of a pig in a poke!

    That!!!8217;s Arnold Clark for you!

Hi, Allan at 69k (depending on how its been driven before) its not unreasonable for the clutch and flywheel to wear out at that mileage ive had a leon before that we changed the clutch on at 70k

Clutch and flywheel especially the (dmf) are prone to wearing out a lot quicker that the solid ones, also they are both a wear and tear item as is the cambelt, has that been changed if not it would also be due soon as the miles will be over 69k since march (whats on the clock now)

as far as gearbox as the gearbox is concerned assuming this is a the dsg if it is the dsg then im not really suprised that its gone as we have seen them go at 40 50 k

try to get them to take a look at the car and try to fix it but i think you may have a battle on your hands in regards to if the clutch is coverd
