Excel PCN - Notice of Itended Court Proceedings

Can anyone help me please. I received a PCN from Excel Parking for a parking violation in April 2018. They included a photo of the car and said I had so many days to pay or appeal. However I had sold this vehicle approx 2years earlier so I wrote back to them and explained the situation, that I had sold the car so they had got the wrong person. I couldnt forward the owners address as unfortunately I cant find it now but I spoke to the DVLA and explained it to them and they sent a letter to me confirming that I no longer own the vehicle.

I forwarded this on to Excel and explained it all, the vehicle is currently taxed and insured and MOT’d so the new owner is keeping it all in order but I have no address details but they rejected this and said I had to pay.

They have today written back with a Notice of Intended Court Proceedings threatening CCJ’s etc and I really dont know what to do, I am certainly not paying a fine for a car I havent owned for 2 years but dont know what action to take.

Cany anyone help please .....

    Send a complaint back to Excel, with the DVLA letter again, telling them they are now processing your data illegally and breaching the GDPR.

    And email a complaint to the DVLA showing them what Excel have done, despite knowing you were not the keeper on the material date.

    Does the DVLA letter confirm you were no longer the RK at the time of the alleged transgression?

    Did you notify the DVLA of change of ownership in a timely manner?
  • Hi, no it doesnt say anything about dates, just that I am not the registered keeper. I did send the paperwork back at the time of the sale and I have never had anything such as tax reminders or anything so I am guessing it was processed ok. As the car is currently all legal it must have been registered in the buyers name I assume so they could tax it?

    So just to confirm, you have nothing from the DVLA that shows that you were not the RK at the time of the parking incident.
    Not really surprising that Excel are continuing to chase you, is it?

    Surely you can get confirmation from the DVLA stating when you ceased to be the RK? That's what you need. You are an easy target until you get that.
