personal items taken from my written off car

tell me what is wrong with keeping maps, handsfree kit for my phone, an umbrella, cds, my st christopher, my gym kit, gym drinks, my yaris approved car mats bottle of engine oil, washer fluid spare driving glasses, driving gloves
all these items are missing. why does someone need to take them. I have my yaris serviced etc with toyota, they are perfectly honest in fact they left me spare oil and washer fluid. In fact toyota give me items for my car not take them. I repeat again, i wasnt given the chance to clear my car at any point even though i asked. so why do we have to accept dishonesty.
I contacted the police and they said that it could be considered as theft. so if they think it is wrong then why should i put up with it0 -

Your car will not have went straight from the crash site to the scrappy
It will have been transferred to a garage, then either assessed or transferred to your insurers preferred garage and assessed
It would then be written off and "sold" for scrap by the insurance company
Once a scrap merchant buys it they buy everything in it
You should have arranged between the date of the crash and the sale of the scrap by the insurance company to attend the garage or have the car returned to you to remove your posessions
You say you never got the chance but if you had asked you would have, I dont really think its the insurers responsibility to hassle you to reclaim your possessions
Whilst I understand why your upset and you have reason to be the person to blame is yourself for not chasing this up before it was sold for scrap
What exactly did you expect to happen once it was sold to someone for scrap? them to put it on their site and keep it in the same condition etc
In everything there is a bit of responsibility on yourself to do stuff0 -
my yaris mats cost quite a lot, and i did ask to get my items but the insurance people kept putting me off. If the scrap people have the contents then why send some things and not others. What use are my glasses to anyone else. The fault is maybe not the scrap dealers but the insurance people instead. I shall write to them and see what happens0

I think this is a classic case of "we are expected to know our rights" but that no-one is obliged to inform us of them.
A case of "you don't know, what you don't know" ...... but that doesn't necessarily mean that someone else is obliged to meet our loss.
I think Martin would call it "Consumer Power - Know Your Rights" or something similar.

Hi DFC, the same thing happened to my partner in March of this year. He skidded off the road in a remote part of Wales and his car was written off. He works away during the week and was half way between home and his 'other home', about 80 miles from either place. It was the middle of the night and snowing heavily. He waited about 2 hours for the recovery people to arrive, then he and the car were taken to their garage. As he was on the phone to me, they were locking the place up around him. He got his bag of clothes and his laptop from the car, but left everything else, CD's, a box of polishes, etc. He had to get a taxi home in the middle of the night, at a cost of £100 and never saw the car or its contents again. He lost several CDs, a child's car seat, car polish, dashboard cleaner, etc, as well as a spare coat, emergency torch, foot pump, etc., etc.
After about three weeks, the salvage company delivered a bin bag with a dirty blanket and a few bits and pieces in it. Of course, the stuff of any value wasn't there.
After complaining to the insurance company he got nowhere, although the write-off he got was higher than expected, so he left it.

Me too in same situ. Accident not my fault two weeks ago today. Car towed as arranged by police. Company towing gave me details and said I could collect items from them. That day no means to get there plus elderly mum was in car and priority was her.
Next day I was really really ill. Couldn't stop crying or shaking . Never felt like it in my life. Insureance company was brilliant .They told me not to worry about personal stuff and delivered a courtesy car the same day. My problem was I was too scared to get in it. Couple of days later advised my car moved miles away - National. Now advised car a write off and offer is a joke. Very angry that the accident wasn't my fault but I'm losing hand over fist. Surely there must be a way to reclaim uninsured losses in these circumstances. I know exactly what was in the car plus my tax disc. I'd only taxed it 3 weeks before and had it MOT'd the day before (£50) not due until after the acccident. All money down the drain. Not a new car but only had 21k on the clock.0
