    I couldn't find much when searching Alun Cockroft but found some stuff on Pepipoo. My statement on this is at paragraph 17.

    The other recommendations of yours have also been included at paragraph 10.

    I'm struggling to find a WS with something about disproportionate costs, despite search.

  • Thanks Coupon. I've just been phoned by the court to say that the Judge has agreed to combine both hearings so the hearing date is being moved from July into September (most likely). Quite pleased about that but because I've been doing so much reading about it, I'll probably have forgotten it all by the time it comes to the next hearing. The other good news is that they have submitted their witness statement but I haven't submitted mine!

    Will update with any further details.

  • Well, I asked the person who phoned me and, I hope they've given me the right information, but they said as the court date would be moving to September or thereabouts, I wouldn't have to submit my WS for the previous deadline. I hope they've got that right!

    Is there a possibility that the original WS deadline would remain, despite a later hearing?

    Maybe.

    But wait for the new order from the court to arrive; the Judge will write spelling out his/her decision to consolidate the claims and what the parties need to do. And if the Order is unclear about that then write back within 7 days.

  • Thanks. The only issue is that the original WS deadline date is tomorrow so by the time the instructions arrive, the deadline for my WS will have passed.
  • Update to say that the cases have been combined and the Court have confirmed that my WS will be due at a new date tbc. Will post when I get further info.
  • Afternoon all

    Due in court at the end of the month and WS due for the combined trial by Monday next week. Just wondering, as the claimant had previously submitted a WS for a one of the claims (before the two had been combined), whether they are obliged to submit a revised statement for the combined case or whether they'll just rely on the original one as both claims have been consolidated as a single trial?
