Comments on Popla Appeal Operator Evidence, Pls help

A PCN from PP - P r e m I e r P a r K citing that the vehicle exceeded the maximum stay period was received.
A POPLA appeal by the keeper of the car citing the following has been sent in:

a) Obscure signage. (photographic evidence included in the appeal)
b) Failure to comply with the data protection 'ICO Code of Practice' applicable to ANPR (no information about SAR rights, no privacy statement, no evaluation to justify that 24/7 ANPR enforcement at this site is justified, fair and proportionate.
c) No Evidence of Period Parked NtK does not meet PoFA2012 Requirements - no evidence of the parked car
d) Vehicle Images contained in PCN: non compliace with BPA COP - timestamps inserted on photos
e) No Proof that the ANPR System is accurate or reliable or has not failed.
f) No Evidence of Landowner Authority - (operator has since uploaded contract as part their evidence)


The Operator PP has uploaded their evidence. Now there are 5 days left to provide comments on their evidence.
The Operator wrote a statement listing what their signage says and their evidence includes:
- Pictures of site plan and signage which are over a year and half old.
- Redacted contract with land owner.

Regarding the comments on the evidence can someone in the know pls answer the following:
1. Is it possible to write more than 2000 words and can I include more photographs too?

2. The operator says that their signs are approved by BPA auditing team. The photos we took show that the signage nowadays, is obscure and not that clear. This has been pointed out in the appeal. Should a comment be added comparing photographs? The photos we sent on the appeal do not have a time stamp.

3. Re APNR: the operator says that 'the British Parking Association (BPA) audits the ANPR systems in use by parking operators in order to ensure that they are in good working order and that the data collected is accurate' This has already been questioned in the appeal. Should more be added?

4. As part of their evidence the parking operator says 'We have not received any advice regarding this vehicle from our client and no request for cancellation'; and later on they say 'We have checked the permits allocated to vehicles. This vehicle is not on the permit system and no permit was allocated on the date of the contravention'. After the POPLA appeal was sent in, we went back to the retail outlet again and got a copy of a second email that the retail outlet sent to the parking operator saying that the PCN had already been sent to them, yet the customer keeps receiving emails regarding this. Should this be mentioned in the comments and is there any way were I can attach a picture of this email to the comments?


Besides the above, is there anything else that needs to be included in the comments?
Any help would be greatly appreciated.

    This is a lie. Complain to the BPA and PoPLA that this is a lie. The BPA have conformed that they do not audit ANPR systems.

    Search the forum for Steve Clark POPLA audit ANPR as keywords and change the default to show results as POSTS.

    Personally I don't believe that the BPA audit signage on individual car parks let alone ANPR.


    As far as I can see the COP says their audit team will audit the PPC to confirm it is keeping to the code. Which is probably a cosy little chat over tea and biscuits in the PPC's offices.


    I could take you to a number of car parks in my home town where signage is virtually non existent, faded, or with text too small to see even when you are standing under it, it can't have been audited by anyone.



    Why not ask for the evidence of the last BPA audit of that particular car park!

    If only you had 2,000 words. It's 2,000 characters (absolute maximum). Time for brevity!

    No new evidential points are allowed. Not sure whether you can add photos to rebut PPC evidence.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Of course the BPA is talking rubbish, they would need
    100's of staff to monitor all their scammers

    And the BPA ........... the scammers friend
    They don't have a clue about ANPR

    No you can't include more photos in the comments. POPLA will not read a whole new appeal or a long response, so do not try.
