  • Just an update: I have finally received a copy of the parking contract from the town council via a FOI request.

    At least, it claims to be the final contract, however there is only an issue date on there, not a start date or effective date. There is also no signature from anyone at the PPC.

    The council rep has said they will try to track the hard copy down.

    Not sure how significant this is but just lobbing it in to the mix.

    Show us your draft complaint to Mr Gallagher the POPLA Lead Adjudictor, citing the above LA Ombudsman finding and asking why POPLA do not understand 'not relevant land' as a concept, and why their Assessor ignored it as it was too hard a subject!

    Ask Mr Gallagher when this Assessor and all the team will be re-trained about keeper liability and 'relevant land', in the light of the LA Ombudsman's report which makes it clear that it doesn't matter if the land is 'under statutory control', nor even whether the LA is working in its capacity as a Traffic Authority, OR NOT!

    They just have to 'be' a traffic authority who is (under any capacity) 'providing' the space as owner, which is what we have been saying all along...ho hum...

    Demand this erroneous decision is revisited, given the Assessor ducked the issue, and demand that the Assessors are re-trained as they are WRONG ABOUT THIS ISSUE.

    How would i know if the land in quesiton in my case is covered by a TRO?

    TBH, i havent yet drafted a complaint to POPLA. I am in the process of losing my job so bigger fish to fry but will try and get it done.

    You dont need it - as has been said, they ARE a traffic authority, they do not need to be working in that capacity.
