Not sure they can insist on refunding with a credit note, I've always understood if they offer a refund it has to be in the same form as the payment. Others will know more but a point that might be worth investigating.
As mentioned, the refund offer via credit note is over and above what they have to offer at this point - so yes, they can. :)

But the retailer get to chose whether to repair, replace or refund. As they're offering a replacement, the offer of a credit note is in addition to the OP's legal reights.

Yes, of course. What I had in mind is if the retailer offers the customer the choice of a replacement or a refund (via a credit note), and the customer says they'll take the refund then they can insist on receiving that refund in the same form as the original payment.

Except that OP has the right to reject for a full refund as the company have already had 1 attempt at repairing the goods and they still failed to conform to contract.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • Although some shops do seem to be clamping down on it. I forget, was it Argos?

nah, turned out there was a fault with it, so entitled to full refund in accordance with consumer rights. Had to give it a real good going over with a hammer to find that fault though...
