Buying Ex Out

Hello :-)
I'm hoping to get some help. I'm currently in the process of buying my ex out of his share of our house, and need to know exactly what the process is?
I've heard of stories whereby the ex still has rights over a property due to names not being taken off deeds and want to make sure everything is sorted.

The process is largely the same as when you bought the property in the first place.0 -
Do you have a mortgage on the property, and if so has the mortgage company given you permission to remove your ex?
You will need to instruct a solicitor to process the transfer of equity and remove them from the deeds, do you have a solicitor?0 -
Yes we have a mortgage, we have sent the paperwork to get confirmation of acceptance, the mortgage company have said that they can appoint a solicitor at our cost but if i wanted my own solicitor the i would have to pay for the mortgage company solicitor and my own.
Is there any benefit of me having my own solicitor?0 -
Hi,
I assume you are not married? If you are married your house will be an asset of the marriage until there is a divorce with financial settlement even if you have taken your ex off the deeds/ mortgage.

Did you have a separate solicitor when you bought the place or did you use a solicitor from the lender's panel of solicitors?
The solicitor acting for the lender has to act in the lender's interests and it is not in the lender's interests to leave someone as a legal owner of a property when they are not party to the mortgage.0 -
We had a seperate solicitor when buying the house but our mortgage lender was different to the one we have now.
I guess i just need to know whats best for me?0
