    1. Failure to comply with the data protection
Never put that as #1, it's merely filler and never wins at POPLA, just there to make the appeal longer and harder for a PPC to rebut or handle. It's always at the end.

  • Britainnia have now uploaded their evidence to POPLA, and POPLA are asking for my comments. What should I put in that comments box?

A rebuttal of all points they have made with which you disagree, or are plainly wrong or misleading. You have just 2,000 characters (not words) to make your rebuttal. Make it short and snappy.

You have to put it into the POPLA portal direct (not via a .pdf attachment).

Is this not covered in the NEWBIES FAQ sticky, post #3? Have you checked?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Unfortunately, my appeal was rejected by POPLA :( and Britannia are now asking for the original PCN amount (£100). Threatening debt collection etc if I don't pay. Have I now reached a point where I have no choice but to pay the full amount?

    No, you have not.

Please re-read the NEWBIES FAQ sticky thread.

A PoPLA decision is not binding on the motorist.

Depends how much you like gambling. Take a look at the current odds for going to court http://www.parkingappeals.info/companydata/Britannia_Parking_Group.html

Whilst getting letters is scary I wouldn't lose too much sleep over those odds.

I rather suspect the 11th person they take to court in the history of their existence will be a softer target than you. For example someone who has racked up multiple tickets and has failed to respond to any correspondence. They would be ripe to attempt getting an easy judgement against.

At least by appealing to POPLA you have indicated to them that you don't simply ignore correspondence and so are likely to defend a claim. You also have marked yourself as a more tricky target, not the low hanging fruit they have always chased in the past.

Search the forum for POPLA lost (why do posters post as if everything is a new thing, and not just do a forum search first, when things crop up?). Everything here has been done before, tried & tested, including losing at POPLA then ignoring any letters except a LBCCC or claim form - that's another shot at getting it cancelled!

So forum search first, at each stage...sit tight, and read other threads.
