Parking Eye Fine Daresbury Brittania Hotel

I received a letter this morning stating i had a parking charge of £100 for parking a total of 23 minutes in the hotel car park. Bit of a weird story as to why i was parked there but here goes....

After getting into difficulties along the M56 and having pull onto the hard shoulder because of a loose tow hitch on the equipment i was towing, my two children and partner had to leave the vehicle and stand on the side of the motorway. During this instance my 8 month old baby was covered in red ants and was bitten several times. She was in great distress and the first place i came across was the Brittania hotel in Dresbury, which was the next turn off on the motorway. My partner went into the hotel to use the bathroom to wash and to calm my baby with the permission of the hotel staff. At no point did i leave my vehicle for the whole of the 23 minutes i was on the site. No cars came into the car park and one vehicle left. As i was in my vehicle i could have easily moved to accommodate any person that needed a space if required and feel there was no possibility of financial loss due to parking fees that could of been obtained by the Hotel. At no point did i see any signs stating that this was a pay and display car park and if there was then they were poorly located to the area in which i parked. With the situation as it was and with the worry that my babies condition may have deteriorated at any time the last thing on my mind was looking to see if this was a pay and display or chargeable car park.

I feel there could be grounds for an appeal for the following reasons:

1. Extenuating circumstances for the position i was in in regards to my 8 month old baby

2. After looking at google maps there is a sign on the entrance stating that the car park is private and details on parking tariffs are available at reception. I feel that the 23 minutes it took for me to enter the car park and leave again whilst also obtaining information on car park tariffs with a couple of people queuing was not sufficient time for me to decide if i wanted to park there in the first instance, although this is irrelevant to my situation. Also there was no other signage once entering the car park

3. Also when my partner asked at reception if she could use the hotel toilet for the baby should she of been informed that there was a fee payable for parking the car?

Does anybody feel these are grounds for a successful appeal or am i going to hit rocky ground in trying to get an appeal upheld?

I am really not clued up into how to fight parking fines as this is my first in over 10 years.

I have read numerous threads and articles on these private companies sending charging notices but they seem old and not sure if any of the appeal methods are applicable anymore, or the terms used are over my head and require a lot of research into what people are talking about.

Please be kind just an uneducated man in the world of parking fines trying to see how i can appeal with successful or valid grounds and seeking advice on how to go about this.

    Yes she should have. Not should of (not being funny, that's not English).

    Complain to the Hotel Manager first. Easiest way to get these cancelled.

    If that doesn't work then you use the appeal in the NEWBIES thread, not write your own.

    Can't stand 'could of and should of' or posters who think there is a phrase ''off my own back'' (hate that one, it's a sporting phrase - ''bat''...).

    Don't expect any sympathy or help from a Britannia Hotel, every last fiver they can earn, even from PPC back handers counts, and their owner has a history of thinking customer service is for idiots!


    Voted the worst hotel chain in Britain for five consecutive years!

    We have sent your PCN to ParkingEye with a request for this to be cancelled. Please be advised the process can take up to 14 working days to be completed. If you receive any further correspondence from ParkingEye please contact ParkingEye directly on enforcement@parkingeye.co.uk to check the status of the PCN.

    Please be aware, there are electronic terminals located inside the building for you to enter your vehicle registration number to qualify for free parking and to avoid receiving a PCN, should you wish to visit Britannia Daresbury in the future.


    I do feel this is not over with Parking Eye, though i am grateful to Brittania Hotels for there understanding of the situation and requesting the cancellation of the PCN.

    Will update once I receive more correspondence.

    That's very good news. Wait a day or two and check ParkingEye online for the status of the PCN number.

    The amount 'due' should change to zero...

    Easy to kill these off with a decent complaint. And it all adds to the Hotel's view of the dissatisfaction of their guests, with this harassing and draconian 'enforcement' that has no place in a customer facing environment like a Hotel.

    One day, these firms/hotels/supermarkets/hospitals will finally learn that they CAN scrape PE of their shoes, and that 'carmageddon' does not result!
