Claiming whilst in overdraft..

We spend most of our time living in our overdraft, and after being out of work for a couple of months earlier this year found ourselves going just (£100 or so) over the agreed limit. This was only ever for a couple of days before we were back within the limit, but still in our overdraft. The problem is that ever since then, we're being hit with charges over £100 a month which, because of our tight budget, means we're constantly stepping over the limit on monthly basis now thus continuously incurring massive charges, which we just can't handle. I've been in and spoke to the manager of my local branch to ask the charges to be stopped for a month so we could keep ourselves within our limit, but whilst the manager agreed with me and said he understood what I was saying, the computer said no so that was that.:mad: Our bank is Lloyds TSB, we have a loan with them which they will gladly honour the direct debit for whether it takes us over the limit or not, but it's sometimes at the expense of our mortgage payment and things are getting serious.
After ten years of staying loyal to Lloyds, I feel they are hanging us out to dry now and our charges over time make quite a sum, which I now want to claim back. We've opened a second current account at a different bank but how would we stand trying to claim when we're in our overdraft? I hope someone can give me some advice because what Lloyds are doing is wrong, even the manager said it!! :confused: Many thanks for reading............

    You can still claim if you're in overdraft. The bank may and try to call it in or even threaten to send to the debt collector. If this does occur, you can let them know some of the debt is under dispute and they should not persue it at this time.
