Often it can take you a long time to find a space, sometimes as long as 31 minutes, before you can even read the notice.

    Read this

    https://parking-prankster.blogspot.com/2014/03/waiting-for-space-is-not-parking.html

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

i pretty much said i was the driver but reading my 1st appeal to smart parking I did not actually specify about the driver so i could now state i was not the driver to POPLA as I had alcohol on this occasion and the driver went shopping on the retail park and she returned after my family meal when i made the call?

also after struggling to park, and then not seeing the only one sign with the t&c's on which was facing a different outlet could i argue a contrat was not formed? thanks for any help

You need to get these and other points you might rely on clearly in your own mind. Dropping random 'thoughts' looking for answers is far too scattergun and random answers may not ultimately fit into the bigger picture.

Read some other POPLA appeals - the NEWBIES FAQ sticky, post #3 and the POPLA Decisions sticky will have links to loads of successful appeals. Go through those as the basis for developing your own and put your draft up here for critique.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
