  • Hello again. I've received the Directions questionnaire (small claims track) from the county court (sent to my current foreign address). I'm wondering shall I accept the mediation service? And how should I fill in the rest of the form as I've contested the court jurisdiction (outside of the UK)?

    Dos it actually matter? This is mind-games.

    You can tell them and the judge to do one. The judge will follow the law and award the case on the facts (ignoring the lack of appropriate language). If you lose they have the option of trying to collect a very small sum over a very large distance. And after 6 years, it is not collectable anyway.

    Do you intend to come back to reside in the UK in that time?

  • Have you applied & challenged jurisdiction? Presumably not. So proceedings having been served within the UK, the claim now rumbles on.

    You must decide whether a judgment matters (it may not if you're unlikely to return) or not. It's unlikely to be worth the candle for the claimant to seek enforcement abroad, but be aware that is a thing....

    In the Directions Questionnaire can a person choose the court for a hearing on papers when living abroad? If that is so would the OP be best to choose Manchester or Skipton ?

  • It's more likely to be the court of the Claimant in such circumstances - or the parking location. Where did you live?

    In specifying the court most suitable for disposal you do need to say why.

    So the OP's case is likely to be heard in Sheffield. I did think that it might be beneficial for the OP to state Manchester if they could.

    My case will be heard in Stafford.

  • Well, I've just noticed that I've contested the jurisdiction in the defence form within 14 days of AOS. When I returned the questionnaire, I've enclosed a statement regarding this. There're no options on their website to contest the jurisdiction.

    Unless Johnersh has a better idea (as he is a solicitor) I suggest you complete the DQ stating that you are outside jurisdiction from the English courts and this was already stated in the defence, and you await confirmation from the courts that the claim is struck out on that basis.

    EDIT - Sounds like you've already done it!
