There comes a point when money-saving becomes parasitic. Expecting others to incur costs to bring you a return you into the parasitic category IMHO.0 -
This is a good question and one I wanted to ask myself, but after reading similar threads on this forum I anticipated that I would not get a constructive response and posters would not answer my question directly and I would get responses such as "what are you claiming for?" and "30% of nothing is nothing". I don't think anyone has directed their response to the question - "Can you make a claim yourself after this group litigation case?"I am aware that there is a Group Action underway against Volkswagen for compensation to be paid to eligible existing and historic Volkswagen owners whose cars are involved in the Emissions Scandal. We are advised that to become eligible to receive compensation, we need to join one of the legal companies who have joined forces (in a cartel I believe) to bring the Action against Volkswagen. The problem is that when you sign up, you agree to give 33% of your compensation to the legal company - yes its no win, no fee, but still thats a lot of cash.
What we don't know and my question to anyone legally savvy on here is, should the Action be upheld by whoever has to do so and Volkswagen do have to make a payout or equivalent - IF I HAVEN'T SIGNED UP TO THE GROUP ACTION BEFOREHAND, WILL I THEN BE ABLE TO MAKE A CLAIM AGAINST VOLKSWAGEN MYSELF .. Thus avoiding the 33% fee payable to the lawyers. Or is the Class Action a closed book, and once the decision is made only those who registered are eligible for the outcome.
In Short - if I don't sign up to potentially give away a third of any compensation, could i apply afterwards and get all the compensation by approaching VW directly once the legal precedent is set.
Its a question that no-one that I can see is asking, the ambulance chasers clearly aren't advising as they want the 33% but the support sites etc are strangely quiet.
So I am reaching out to anyone who may be in the know for advice - there are 3 months to sign up to the Group Action and give away 33% of any "reward".
Note - this is not a question about the ethics of why 33% - clearly the legal companies are taking a risk and will want recompense for that risk. This is fundamentally what are the options post any positive decision for those of us to help us decide how we could proceed.
Should the claimants be successful I would be very surprised if you would not be able to make a claim after the ruling as a precedent will have been set.
In fact I think it will be probable that Audi will be obliged to contact all other owners with an offer of compensation
I was going to sign up with Slater & Gordon even after seeing their £500 per hour charge out rate but one thing put me off and that is the compensation will probably be split evenly regardless of what you would of got were you individually assessed.
That means that someone that has owned one these vehicles for a long time, high mileage and initial high cost would get the same as someone that has owned the car for a couple of months.
For example a person who would have got £10K individually assessed will get the same proportion as someone who would of got £1K individually0 -

Those are legitimate questions to ask; nobody is going to say they should make a legal claim if they don't even know what they are claiming for!Dangerous69 wrote: »Should the claimants be successful I would be very surprised if you would not be able to make a claim after the ruling as a precedent will have been set.

So if your considering it then you must be able to explain how this situation has caused you a financial loss that makes you eligible for compensation?
If you can't answer that then it's immoral and a waste of time to take part in legal action.
Personally i think it will turn out like the Red Bull case and everyone will get $10 each.0 -
What a shame. Someone asks a reasonable question and the haters can't wait to get on and start criticising the OP. He didn't ask for your opinion on the rights and wrongs of the group claim, just for some specific advice. If you want to vent your spleen, go onto the Daily Mail website and vent away. This is not the place for it.0

I don't see a reasonable question in the opening post.0
