    cross each bridge as you come to it , the time for clever terminology is in a defence and a witness statement being seen by a judge, whereas you need to point everythingout to an assessor at popla (who isnt legally trained and is definitely NOT a judge)


    we want you to win now to remove the threat of court , using tried and tested paragraphs that have won previously


    you said you were lazy, so find and adapt a previous winning popla appeal, it doesnt get lazier than that , and being extrtemely lazy it looks like you hadnt read the popla submissions info in the NEWBIES thread (a foolish thing to do)

    I did read them, and the few in particular that related to points relevant to my charge I went over numerous times, hence all the points raised being bpa code of practice failures. The only difference is I didn't include long case examples of each point, as this was a 1st draft of points. Stop being mean lol :p

    lets hope the final popla draft is better than the one on page 2 , because I give that a 3 out of 10 and expected better, as did other people reading it


    I gave you the categories and order of merit, the rest I leave to your copy and paste efforts from previous winning popla appeals


    frankly, I have read through the whole thread several times and dont think you are taking this seriously , or that you even look at or digest the replies

    Wow, I've brought up every single issue where it falls foul of bpa guidelines, the same ones also all brought up in other appeals,. Unless you have a score of other, secret points, that are not mentioned in any of the appeals, then I'm not really sure.

    As mentioned before, the only difference was not including or referencing winning cases on each point, which I pointed out, I wasn't at that stage, being a draft.

    The copy & paste POPLA template points we use, have potential in themselves to win the case, and POPLA just choose one. They only ever choose one winning point, and disregard all others, no matter what style of POPLA appeal you write.

    You need the usual template points, not just stuff ab out the signs, and not just things about the BPA CoP (a breach of the BPA CoP does NOT in itself, win a POPLA appeal - the Lead Assessor said so).

    You've missed out 'no landowner authority' - the template which wins loads of POPLA appeals. It's in the NEWBIES thread post #3.

    You also had a few typos like 'peruse' instead of pursue (and others) so it needs a check-over.
    (2) Falling foul of POFA rules:
    That's better headed up 'no keeper liability' and should be #1, before the signage point. Make it easy for the Assessor to choose the winning point!

    This thread is almost 18 months old, little chance of any response from the original poster who hasn't been seen in these parts for almost 12 months.
