I know someone who is on housing benefit and the husband gets pension credit as well, he has a private pension as well I think, so is it illegal to claim the benefits?

Oh dear. What makes you think it's illegal? Jealousy?

I know someone who had a state pension & 2 private ones & got pension credit which got him housing benefit. He was completely within the financial limits for this. Can you quote the amount of actual income they receive before the benefits? That is the only way to know if they are entitled!

The answer is 'it depends'. Pension and other income MAY affect entitlement to other benefits but certainly not always.
