The manufacturer have agreed to pay what ever price is given and composition so no issues on that as it's a 2016 car but the financial ombudsman has advised me to go down the route of asking for a refund from the finance company as they are classed as owning the car and selling it. But with the millage I was working it out from when I had it back march 2017 iv only put 19,200 on it the 4.800 was before I got it so I haven't gone over the agreed limit witch the dealers confirmed for me. Plus iv been left with out are car since July 13th and I live in middle of nowhere :(
Refund of what? It's the finance company who own the car therefore it is they that require the finance paying off.

    Who is the manufacturer?

How much are the manufacturer offering?

Have you actually spoken to the finance co and your insurer for that matter?

Please if people are going to reply read the comment the manufacturer have agreed to full liability and to pay what ever is needed as the car catching fire was not my fault.
Apologies, but your original post is not the most clearly intelligible.

But that doesn't actually change anything. The manufacturer just pay the finance house's settlement figure. Everybody walks away happy.

The only question in your original post is...
"And if it's 10,000 a year and I'm on my second year then iv only gone 4000 miles over ???"

Well, that's the only bit with question marks, but it doesn't seem to be a question.

The answer is that the mileage is irrelevant. The manufacturer has accepted responsibility, so is settling the finance.

I spoke to my fiance who said I won't see any money back

Are you expecting to end up with some cash? Why? (The car doesn't even belong to you)

Unless you paid a huge deposit, the market value of the car will be below what the finance settlement is (negative equity) and the finance company will be chasing you for the difference.

If you bought a Mustang, and it is worth more than the purchase price, then the difference between the insurance payout and what you owe on finance will be paid to you by the finance company.

manufacturer have claimed full liability and willing to pay. Any advice welcome.

Are the manufacturers going to pay the shortfall- the difference between the insurance payout and the settlement demanded? (they are acting as gap insurance?)

If so, Bonus, as you won't owe a penny, and can take out another finance deal if you want.
I want to go back to The Olden Days, when every single thing that I can think of was better.....

(except air quality and Medical Science ;))

Sorry but your OP is a nightmare to read. Using threw instead of through doesn't help, and using text speak also makes it less than intelligible. I'm not part of the grammar police but it is difficult to read.

    What car?

How much was financed? [Value of car minus deposit]

    Did you have GAP insurance?

What are you expecting the outcome to be?
