There is usually a provision in the contract when buying off-plan for minor differences from the original plan, but I doubt that losing 1/3 of your windows size falls into this category.
But I'd hazard a guess that (a) the smaller windows are what's been approved by the planners, and (b) the OP's contract says the developer is to build in accordance with the planning consent.0 -

Is there any way I can get these exact planning docs from somewhere?
Also, how would I counter his argument as like I said the Floor plans show the windows as being the wider ones as there is a frame between 2 panes but with mine it’s just 1 pane.This is a system account and does not represent a real person. As in Post 8, if you input the address of the property (flats) into the planning search section of your local authority's web site, the documentation should be there to examine.
All local authorities put their planning documents on-line nowadays.0 -
@davesnave Sorry for the oversight. I have now found it. The plans show the windows should be the same throughout the building and there is no difference in our plot. What can I do? You could draw the plannng officer's attention to the developer's failure to comply with the planning consent. Dubious as to whether this would help you....
You could ask the developer to provide some financial compensation to you for putting up with windows that don't comply. No idea how you'd assess the appropriate compensation.
You could attempt to reverse your purchase - get the developer to buy back the flat from you at the original price. Good luck with that too.....
