The keeper could reply to the NTK and state that it arrived too late for keeper liability under the POFA (you already know those dates from the Act, as linked in the NEWBIES thread) and that, if Millennium continue to process his/her data when they know they missed the NTK service window, he/she will complain to the ICO*.

*Google it - complaints are easy to do online but need to be well worded.
