as mentioend above, they like to give out smoke and mirrors and claim that people owe them money, yet when failed with the truth they choose to duck out at popla and try to save themselves the popla fee
had they done their due diligence in the first place, these cases would not get as far as they do, but they play the numbers game to try to frighten people into paying
until parliament approve Sir Greg Knights bill later this year and it gets royal assent (perhaps next year) - nothing will change
so as mentioned, complain to your MP and get them to support Sir Greg Knight

POPLA appeals v NCP are pretty much always winnable, and end up like that, with NCP throwing in the towel when they see a forum appeal.

In regard to membership cancellation - if your loyalty to the gym is only important one-way, then do you just simply suck it up that they are point blank refusing to help, or do you do something that makes them think hard about how they treat their loyal customers. Cancellation is of course the Armageddon option, but threats of it might be enough. (Notwithstanding what arrangement there are between them and the PPC, not that they appear to have tried to explain it to the OP. But we hear so many mealy-mouthed lies from retailers and the like, trying to distance themselves from the dispute, leaving their customer cast adrift, that it's hard to know what the reality is).
If my (well, Mrs U's) supermarket refused to help with a ticket, costing us £100, for sure that would be our final visit. But we won't get caught out!
I hear what you are saying, but the thing is it is the closest gym to me and open 24h a day which suits my needs at the moment therefore don't want to change or cancel my membership.
I also believe they should have fought this but who knows what would have been said, what arguments would they have used etc. At the end of the day, the gym itself is not charged with a £100 fine so in my opinion they couldn't care less. I also don't think they would care if they lost one member due to this dispute. I will forward my complaint to our MP at some point though.

It really should be included as an element of the driving licence theory test.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
