Proof of purchase

Hello all
I purchase a chrome towel rail/ radiator through eBay in 2014 and paid through paypal , the radiator came with a 5yrs warranty and I have just contacted the company because it has started rusting all over .
I provided all my details along with ...
EBay item number
Paypal transaction id
Exact date of purchase and amount
I even have sent a screen shot of the paypal transaction with all the info shown incl payment to their email address .
But the response was we cannot help you without our order number :think:
Can they fob me off like this ? I hate been beaten :cool:

    If you are claiming under the manufacturer's warranty then they can impose whatever terms they wish. Your statutory rights are against the seller so you could pursue them for a remedy.

    Yes they can impose whatever condition they like.

    Have you tried to contact the seller and ask for an order number?

    Am I right in thinking my contract is between me and the seller

    Any consumer rights you have are with the seller.

    Any guarantee is from whoever supplied it - guarantees are usually given by the manufacturer, normally with the first year coming from the seller. You would need to check with the seller as to when their cover ended (if there was any) and when the cover start/ends with the manufacturer.

    The seller refuses point blank to help because I cannot supply an invoice number ,I was going to approach the manufacturer but couldn't trace who it was .....
    Jumping the gun I know but as they will not budge or even discuss I've just been online and put it in the hands of the small claims court ..

    What information have you got about the manufacturer so far.
    Is this item still being sold anywhere?

    Did you send them a letter before action? Did you tell them you wanted to claim under your statutory rights rather than any warranty?

    The issue you have here is that under warranty, they can have whatever terms they like (providing they're not unfair/unenforceable). Including refusing to issue a replacement/refund under warranty unless you supply an invoice number.

    Under your consumer rights, they can't insist on a invoice number but aren't due to provide a repair/replacement/refund until you prove the lack of conformity and also that the lack of conformity is inherent.

    With a bit of luck, the retailer will cave. If not then you've potentially just thrown good money away.

    It's a mine field I know but for £25 to do it I thought what the hell ....
    I just cannot understand their mentality as it's no going to cost them anything as the manufacturer should swap the item .
    I politely told them the problem and it wasn't of satisfactory quality and not fit for purpose as it should of lasted longer than 4 yrs but they didn't want to know after numerous emails and telephone calls . They tried to fob me of saying try the manufacturer but I said my contract is with them who I purchased the item from ...
    They still stock and sell the radiator I bought 4 yrs ago so must have a good relationship with the manufacturer

    Contact the manufacturer and ask them about the warranty and what you need to do .

    Tell them you have bought it from xxx , they may say they don't deal with that person and the item you have maybe a cheap knockoff version of theirs, which then you have a better chance in the court.

    It just brings up suppliers ..... I did ring one of them and cheekily as if they knew the manufacturers details but they wouldn't say which is understandable. .... I think they though I was trying to buy direct and cut them out
