Blackhorse demanding my Decree Absolute ?!

Hi All - just wondering if any else has had similar issue with Blackhorse ?

I am looking into a PPI issue for some former car finance. At the time of the agreement I went under my former married name.

Blackhourse are refusing to deal with my queries until I give then the reason for the name change and details of my divorce.

They initially asked for a Divorce Certificate - I politely explained that there was no such thing, then they asked for my Decree Nisi, which I explained would not give pertinent information, as it was not proof of divorce.

I explained that my Decree Absolute was proof of Divorce, but it would not demonstrate any change of name information.

I politely explained that I have a Name Change Deed, drafted by my Solicitor at the time. That document has been sufficient for all my banking providers, Driving License, Mortgage provider, Job applications etc etc.

I explained that neither my ex husband , or my marital status, had or has had, any bearing on the agreement I held with them - the agreement was with myself.

The person I spoke to was aggressive and demanding - he gave me a lecture on how only name change by Deed Poll was "legal" and that they would not deal with me further, until I gave them my Divorce details and the "reason" I had changed my name - he started quoting "Data protection" and "Financial Conduct Authority" at me and refused my request for their Data protection policy.

I explained that a change of name was a personal choice and was not dependent on any other factor - he was NOT accepting of this. I offered to send copies of the Name Change Deed and of my Driving license - he stated that it was inadequate and that they insist on seeing my Decree Absolute.....or, as they like to cal it, my "Divorce Certificate" :rotfl:

When I politely asked for his surname, as I intended to take the matter further, he refused ( I do understand, the reasons for this...I suppose.....) .. I then had another lecture about why this was so. I accepted his reason,, but quietly chuckled, as it seemed so incongruous..this man was demanding the intimate details of a very troubled period of my life, yet would not share his name with me...hey ho :)

I politely brought the conversation to a close , I explained that I found his tone and manner aggressive.

Am I loosing my marbles guys ???? But I believe that my Divorce, or the personal reasons why I chose to change my name, have no bearing on the matter ?! ....it's not any of their business , surely ??? :(

    It is their business to establish you are who you say you are.

    If you don't want to provide them with the proof they have requested, then forget about making any PPI complaint.

    The manner or tone of the person you spoke to on the 'phone is irrelevant.

    If it was sold by a car dealer than its not Black Horse you should be dealing with (unless it was the less common situation where the dealer was an agent of Black Horse).

    That is reasonable and expected. You can be attempting to commit fraud. They are required to verify ID.

    A certified copy of the deed poll should be fine. You expect names of documents to be confused as you are not dealing with highly qualified people and a change of name is not a common thing.

    However, do note that if you bought via a car dealer, it is the dealer you should be complaining to. Not the finance company.

    But I have offered to give them the information that they requested ( " written confirmation or proof of your name change" ) in their letter to me (forgive me, I should have explained that....I only rang to get an e mail address to send the thing electronically).

    It was during the phone conversation that they started going on about Divorce documentation. They cannot give me a rationale for wanting my divorce document, other than they see it as "proof" of my change of name - which it is not .

    With regard to their "tone" - not irrelevant to me - politeness and courtesy are important - maybe that is why elements of society are changing for the worse - people don't value those things any more ? Such a huge shame.

    Thanks, but I have established that they are the right people to be dealing with, I got that far with them :)

    I fully understand why they need to establish who I am and more than happy to provide them with that info. But they are not accepting the Name Change Deed drawn up by my solicitors - Deed Poll is not the only legal way to change your name. They seem to think that a Decree Absolute is proof of name change - it is not.

    It's irrelevant since complaining about it will still mean you have to provide the required ID.
