Kearns Solicitors debt help

I really need some help and I don't know what to do.

I moved home in August 2017. In February 18 I got a letter to my new address from the courts saying a CCJ had been awarded against me for an old MBNA credit card which has defaulted in 2013. The card had had a balance of around £2000 on it, but there was an extra £1000 added on top for fees and interest, so my debt on this card is now over £3000. The repayment amount on the documents is around £140pm.

I had not had any letters beforehand saying it was going to court stage, they had been sent to my old address, I know as they eventually found their way to me as I work at the same place as my old handlord. Even though they clearly had my new address as this is where the court papers cam from.

A couple of month after I tried to call them (Kearns solicitors who the debt is with) to try and set up a payment plan to pay it back as can not afford the amount on the paperwork. They told me as it is a CCJ the courts set the amount and I would need to call them and fill in a form to change the amount. Called the courts, they said it wpuld cost £50 which I could not afford and that Kearns would be able to adjust the amounts and notified the courts.

Tried calling Kearns back, who refused to adjust the payment amount to an amount I can afford and unless I cleared the arrears (£420) they would be passing it to bayliffs. I asked to speak to manager, said I wanted to pay the debt, but could not afford the repayments. They said a manager would call me back but never did.

So I set up a standing order for £10 per week to pay the debt back, but got a letter from the court saying bayliffs would be out unless I paid £204, this was in June. My mam lent me the money to pay this to stop the action. Have continued to pay £10 per week.

Got another letter end of last week, dated 11/07/18 saying again, unless I cleared the arrears they would send bayliffs and charges may be added. Have now had another letter from the court saying bayliffs will be out unless I pay £204.

I feel completely helpless. I can't afford the repayment amount, I can't afford to clear the outstanding amount, Kearns solicitors aren't going to come to an alternative arrangement with me and feel like we're just going to go round and round in circles with this, while getting further and further into debt with extra charges being added on. I'm going to clear the amount the bayliffs ask for, then a few weeks later they're just going to pass it to bayliffs again.

    Vary using form N245

    court forms

    You can find most court forms using the court form finder on the HM Courts and Tribunals Service website. You can fill in application forms online and print them off to sign and send to court.

    You can apply for a variation using form N245 if:
    • you did not reply to the claim form;
    • you replied admitting the claim, but did not make an offer to pay;
    • you replied admitting the claim, and the creditor accepted your offer of payment; or
    • you defended the claim but lost.
    Complete a personal budget. Make sure you include all your income and outgoings from your budget on form N245. If you are a couple, it is usually best to include your total household income and outgoings. Make sure you include details of all the payments you make on your debts. This will make it clear to the court that you can only afford to pay the amount you have offered. Contact us for advice if you have any problems filling in the form.
    • Send or take the N245 to the court that made the CCJ, unless the case has already been transferred to your local county court hearing centre.
    • You will have to pay your fee to the court when you give them the application, unless you qualify for help.
    • Keep a copy of the completed form. The court will send the creditor a copy of your application form.
    If you do not qualify for help with the court fees, then take the £50 from elsewhere in your budget, as it is the only way now to deal with this matter, and avoid bailiffs knocking on your door.
