Do I have grounds to appeal against London Parking Solutions?

Hello,

Our car was parked on 23.06 at a construction site entrance (out of hours) with the landowner permission.
We just came back from abroad to find a Parking Charge Notice to Registered Keeper issued on 02.07 by London Parking Solutions, member of the IPC.

No PCN ticket was issued and displayed on the vehicle at the day of the parking.

There is a sign at the site which states no parking on roadway or payment, however a staff member from the contraction site allowed the parking at the entrance as it was out of hours (Saturday - 9.00 pm).

We now we have only 1 day within the 28 days deadline for the payment.

Do you think there are any grounds for appeal here? Any pointers will be much appreciated.

    As above. Read the NEWBIES and get the appeal sent off today.

    You also need to edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    Today I received the below response. Any suggestions what can be one next will be greatly appreciated.

    Thank you for your appeal against the above Parking Charge Notice ('PCN') which has been carefully considered, however,
    on this occasion,the appeal has been rejected for the reason(s) detailed below.
    Your vehicle was parked in an area of the site which is designated as No Parking on Roadway or Footpath. Notice of the terms
    and conditions of parking is served by way of numerous large warning signs. Please note that you can visit our website;
    https://www.paymypcn.net whereby you can review photographs of this parking event.
    We are advised by the DVLA that you are the registered keeper of the vehicle. As such, and in accordance with schedule 4 of
    the Protection of Freedoms Act 2012, if you fail to provide our Client with the name and address for the relevant driver,
    then they are entitled to hold you liable for the amount claimed. In respect of the signage, our Client is a member of the
    International Parking Community ("IPC") and all signage has been vetted and approved as adequate.
    The comments you refer to (which /Watchdog) relate to a minority of rogue Operators and do not reflect the private parking
    industry as a whole. We kindly ask that you refrain from repeating these statements which could of course, be damaging to our
    Clients reputation. If you repeat such allegations and in the absence of any supporting evidence, our Client reserves the
    right to seek redress via the appropriate channels.
    We are unsure as to why you believe you have been the victim of predatory tactics. Your vehicle was observed and recorded as
    being parked in an area where parking is not permitted and in accordance with the displayed terms and conditions of parking,
    you have received a parking charge notice.
    After reviewing this matter we are satisfied that the PCN was issued lawfully and correctly and on this basis your appeal is
    rejected. Please refer to the main body of this letter to see your options.
    You have now reached the end of our internal appeals procedure and you now have two options:
    * You can pay the total amount due of £100.00 within 14 days (see reverse of letter for payment options).
    * You can appeal to the Independent Appeals Service (IAS) if you believe this decision is incorrect
    In order to appeal the IAS will need your PCN number, vehicle registration and the date the charge was originally issued.
    The IAS (https://www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of this type. As you have
    complied with our internal appeals procedure, you may use and we will engage with, the IAS Standard Appeals Service
    providing you lodge an appeal to them within 21 days of this rejection.
    IMPORTANT NOTE:
    Should you decide to appeal to the IAS and your appeal is subsequently rejected, the option to pay a discounted
    amount will no longer be available and the full amount of the PCN will become due, payment should be made to the
    Operator within 14 days from the date of the IAS rejection notification.
    If you do not make payment, the outstanding PCN will be passed to our appointed debt collection agency

    its a template rejection, they probably never even read the appeal


    IGNORE now and come back if you get an LBC or an MCOL within 6 years

    All IPC threads are the same. Read a few, there is no step to take now. Ignore.

    Read up on court claims and take confidence from the fact we win 99% of the time here, in case they try a claim. You can see how likely that is by doing the search the second post of the NEWBIES thread tells you to.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Everyone has grounds to appeal private parking charges as so many are fraudulent.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
