Your right under the 14day also don't apply since you have booked for a certain time and day which falls under the exceptions.
But the exceptions stated in the CCR's only apply if the trader has complied with their legal requirements to provide certain information before the contract has been made and one thing that must be made clear to a consumer is if there is or is not a 14 day right of cancellation.
In fact, it sounds as if the OP didn't receive any of the required information in which case they are not legally bound by the contract.
Consumer rights legislation is good for the consumer but it also gives rights and more importantly, obligations for businesses and if they don't abide by those obligations they can't expect their customers to be bound by the legislation.0 -

Was the lesson booked online or by phone? Did they receive any confirmation of the booking either by post or by email?
If this is a solo instructor, then perhaps they haven't done things by the book as they are local independent instructors.
However if this is a company with multiple instructors, one would have thought they would have been in this position before and having had their fingers burnt previously, they would do things differently and comply with all legislations.
Op said they didn't have any issues with previous instructors. So have they had lessons with the same company in the past? How long ago and were they sent terms and conditions then?
If they have done business with them before, then they should know about their terms of business.0 -

ok, so how does their website work?
Do you register with the website for an account. once you have an account then you can book a lesson and ... ?
It maybe that when you register for an account ( if it works that way with them ) , then you click the box to say you have read their terms and conditions and accept it.,

Hi everyone thank you for your replies. I received a phonecall today saying they would send me a full refund via cheque which I will receive in the next few weeks.
In response to some of the questions on this board: It was with a firm I had never used before. They have a large organisation that employs multiple instructors and like I said gave me no information at all about any terms, and you didn't have to register for an account. I'm between jobs at the moment so was called in urgently to train for my new role that is starting soon as the prior arranged date had to be cancelled due to staff illness, hence why I couldn't give longer notice. And I wasn't trying to use the 'I'm a female driver card' I just felt I was being taken for a bit of a mug yesterday and wasn't happy, especially as I did not know what my rights were so thanks very much to unholyangel and George Michael for informing me of those.0 -

As this was for a specific event on a specific date/time, would this fall within the exclusions to the cancellation rights?
The exclusions are for:(h)the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.
Which one of those do you think driving lessons would fit into? IMO it doesn't fall into any. You're not entering a contract to rent the vehicle and nor are you entering into a contract for leisure services.
