Permitted development rights removed

Hello, the area i’m in has had permitted development rights removed in 1994, houses by me were built in 1999.

My council is a bit odd in the fact I wanted a 2m fence installed but they sent a government link something like gdpo? Which states I need planning permission, fair enough

I also wanted something else and said I require PP as permitted development rights were stopped in 1994 but under that gdpo link it mentions about permitted development so the council seems to be picking and choosing what they want.

Anyway.. as permitted development rights was stopped in 1994 for no reason (area is not a conservation area or anything particularly fancy), I was wondering if there’s anything that can be done as it’s been in place for 24 years for no need.

Do I need to speak to an MP or someone else? I can only imagine they stopped it as someone thought “oh for each planning application at £200+ we’d make loads of money”

So has anyone (whole town) ever had permitted development rights reinstated and what was needed to do that

    It may be that it was a condition of the original planning application in 1994 that the whole development loses its PDRs.(our small development of 20 houses had that planning condition)

    I'm guessing this may have been a large development and your house was built in a later stage.

    Your post is a bit confused.

    You don't need to speak to an MP. They didn't remove rights to make money, they removed rights because the development was probably at the limit of density and so they want to approve anything that could affect others.

    It's expensive for you, but it's fair to you and your neighbours to ensure that what would normally be permitted development doesn't actually affect the amenity of surrounding houses.

    There will be a reason, you just haven't found out what it is yet.

    PD rights removal will either be through a planning consent for the property, or an Article 4 direction which may apply to a single property, a specific area, or to a whole authority area.

    Before seeking to challenge this you will need to find out the source of the restriction, and the reasons for it.

    You might be able to find this on your local council's website, if not, contact them and ask.

    Just because you need to apply for planning permission, doesn't mean you can't do it. It just means you need to apply for permission, and it will be evaluated against the local planning guidelines.

    Speak to your local planning dept and ask them whether what you want is likely to be granted. Or read the local guidance. It's probably online or in a leaflet available from your council.

    My house has permitted development removed. I applied for planning for an extension and it was granted and I didn't have to pay any planning fees either (not sure if that's just my council, or because PD were removed).

    Pasturesnew yes you've just reminded me ... It's also the case here that if you have to put it for planning due to removal of PD there is no application fee. Don't know if it's nationwide but it makes sense as its their fault you're applying!

    I did some research on a place we were thinking of buying that had PD removed as it had become a conservation area, and applications were free.
