ActivInstinct eBay Scam?!

ActivInstinct are the new incarnation of millets. I believe they are part of Sportsdirect /JD Sports.
On Monday I buy a pair of running shoes for £109, reduced from £150 on their eBay page. They had a variety of sizes and colours, all irritatingly at slightly different prices.
The following morning they tell me they are sold out (so they listed stock they didn’t have), and that I can wait two weeks on more stock or get a refund. I asked them to send a different colour but they said no can do, different price.
The following day I spot the trainers listed again with my size and the colour so I emailed to say please get them posted. “No can do” they say, they cannot price match them as these ones are £140. I point out it’s the same shoe.. same model... colour... size... but they say “market conditions” affect prices... and I’d have to cancel and reorder at the higher price. Yup, insane. They say they cannot price match these ones!!! :mad:
Check out their rating on trust pilot and their eBay feedback. They are scamming many people with this.
Are they breaching any consumer laws? This wasn’t a pricing error, they are unashamedly refusing to post an item just because they put the price up a couple of days later!!!
When they say they are out of stock, they are meaning the £109 stock... which is ridiculous!

Have you left negative feedback and low stars?
I would order a 2nd pair.. Eventually they may get some in stock or stop listing them.Censorship Reigns Supreme in Troll City...0
