  • If it goes to court you as the defendant get to choose which Court the claim is heard at so YOUR local Court and yes you can claim costs but you have to in tip top shape defence wise to get them. (not impossible many do win costs with the good help here)

    1) you assume wrong, assume makes an @$$ out of u & me

    it can be dealt with on papers any this can be decided up to about a week or two before the hearing

    2) not unless that is your local court ? which I doubt

    if they are suing a private person, its the court local to that person, whereas for a business I believe its a court near to the claimant ?

    3) if you win then costs will be one of the main issues you will require , so a costs order needs to be made

    you really need to study post #2 of that NEWBIES thread and read what BARGEPOLE & LOC123 and others have said, instead of making rookie assumptions


    the CCBC in Northampton is an office, not the court, the court in Northampton is a totally different address

    Only for companies; for a Sole Trader/Partnership business then it would local to the trader/partner.

    Thinking about the defence, should anything be in there reference my permission to actually be onsite, parking permit or such? Or shall i leave that for the witness statement later, or can I only expand upon the points that I put on the defence on the witness statement. seem to recall reading that recently.

    If not, and all is well then I can submit. bargepole says to send it Via rerecorded post but then there is a post on PG1 saying to email, given the bargepole post is older, is email now the preferred way to handle this defence as outline in previous post?

    And after many months of waiting it has been confirmed that I will be going to court next Tuesday.

    I had Gladstones ring me up and ask If I wish to settle, to which i said not a chance. See you in court!

    It will Be 2 years and 1 month from the date of the first offence, I wonder if they take their time thinking that I will have no recollection of the event or have lost all of the information.

    To be honest I think this is going to be somewhat amusing as I have everything I have ever sent to them and their replys, along with all of the original permits/passes and a host of photographs of my work on the site up on the plant deck installing the AC system.

    Its surely going to cost Gladstones more to come down and see me here than just to write this off...

    Have you filed and served your Witness Statement and evidence?

    Take a payslip or other proof of lost earnings to attend the hearing.

    Send a Costs Schedule to the Claimant and Court at least three days before the hearing.
