As a driver you need to produce a certificate of insurance to the police on demand.

You have 7 days from that demand to show them at a police station. The only reason the car was seized was because of an error on their system, and the police officer not ringing the correct department to check this. It isn't illegal to drive around without insurance documents to hand.

This has been confirmed by the police themselves to me, and I have been issued an apology.

Do you not also have your own insurance for your car? If you do and are fully complete that usually allows you to drive other cars, so if you had given your own insurance details and there would have been no problem. It's not their fault that your girlfriends old insurance company made an error, it's not their fault that you don't carry a phone or documents with you, it's not their fault that you don't know who it's insured with. They are no mind readers

I am insured on my own car, he could see that on the system. It doesn't cover me driving other cars. So that is irrelevant.

The old car insurance making that error didn't void my car insurance, and didn't stop the police finding it in the station or over the phone. The police have confirmed this to me themselves now.

They don't have to be mind readers. I told the police officer I was insured, as a I driver I don't legally have to do any more than that. The police officer made a mistake by not checking properly. Again this has been confirmed to me by the police.

It's innocent until proven guilty, not the other way around.

Anyway this will be my last post, it is resolved now.

No, you have a defence to not producing at the time if you produce within 7 days.

The offence of failing to produce is committed at the roadside.

I don't understand your first sentence. But every thing I have read online on police sites and law sites, states that if you cannot produce insurance documents then you have 7 days to show them at a station.

Anyway its pointless me debating with posters online. The police have stated I didn't do anything wrong, and its a mistake on their system resulting in the car being seized. Obviously this may not have happened if I had a hard copy of the insurance documents with me, but I assume a lot of people don't carry them as it isn't a legal requirement.

    Thanks to everyone that helped.

It's not a legal requirement to carry them but oddly an offence not to produce them.

I always keep a copy of my policy and my breakdown policy in my car - just in case!

So now your saying you simply told the officer you were insured and when he said you weren't you just went along with it?

You would have saved a lot of time and police resources if you had simply worked with the officer like a reasonable person to sort out the issue.

No I didn't say that anywhere... what I said was what people legally have to do. I have already explained what I did. I repeatedly stated I was insured, he repeatedly told me that I wasn't based on what his computer was showing him.

Anyway it is obvious you're an argumentative person/troll so I will leave you to it.

What did the MIB say when he called them?

I will make sure I have a copy of my insurance policy in the car
Me too, then I know and can show who I'm insured with.

Police don't check the MIB, they use the PNC.
